(Amendment No. 2)
Regulations 2012
In exercise of the powers conferred by section 56(1) of the Sale of Food Act, the Minister for National Development hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Food (Amendment No. 2) Regulations 2012 and shall come into operation on 3rd September 2012.
Amendment of regulation 16A
2.  Regulation 16A of the Food Regulations (Rg 1) is amended —
(a)by deleting paragraph (1) and substituting the following paragraph:
(1)  In these Regulations, “anti-foaming agent” means any substance which prevents or reduces foaming of the food.”; and
(b)by deleting sub-paragraphs (b) and (c) of paragraph (3) and substituting the following sub-paragraphs:
(b)fruit juices and fruit cordials;
(c)non-alcoholic drinks; and
(d)jams, fruit jellies and marmalades.”.
Amendment of regulation 22
3.  Regulation 22(2) of the Food Regulations is amended by inserting, immediately after the words “benzyl alcohol,”, the word “beta-cyclodextrin,”.
Amendment of regulation 23
4.  Regulation 23 of the Food Regulations is amended ––
(a)by deleting sub-paragraphs (b) and (c) of paragraph (2) and substituting the following sub-paragraphs:
(b)L-glutamic acid, mono-sodium L-glutamate, monopotassium L-glutamate, calcium di‑L‑glutamate, monoammonium L-glutamate and magnesium di-L-glutamate;
(c)Inosinic acid, guanylic acid, di-sodium 5’‑inosinate, di-potassium 5’-inosinate, calcium 5’-inosinate, disodium 5’-guanylate, di‑potassium 5’-guanylate and calcium 5’‑guanylate; and”; and
(b)by deleting paragraph (4).
Amendment of regulation 26
5.  Regulation 26(4) of the Food Regulations is amended by inserting, immediately after the word “crustaceans” in sub-paragraph (a), the words “and molluscs,”.
Amendment of regulation 31
6.  Regulation 31 of the Food Regulations is amended by deleting paragraph (7) (including the heading “Selenium”).
Amendment of regulation 32
7.  Regulation 32(3) of the Food Regulations is amended by inserting, immediately after the words “preservation of”, the words “liquid egg products,”.
Deletion and substitution of regulation 34
8.  Regulation 34 of the Food Regulations is deleted and the following regulation substituted therefor:
Mycotoxins
34.—(1)  Subject to paragraphs (2), (3) and (4), no article of food shall contain any detectable amount of mycotoxins.
(2)  No person shall import, sell, advertise, manufacture, consign or deliver any article of food containing aflatoxin B1 or total aflatoxins (B1, B2, G1 and G2) in excess of 5 parts per billion.
(3)  No person shall import, sell, advertise, manufacture, consign or deliver any milk containing aflatoxin M1 in excess of 0.5 parts per billion.
(4)  No person shall import, sell, advertise, manufacture, consign or deliver the following foods containing patulin in excess of 50 parts per billion:
(a)fruit juice; or
(b)food containing fruit juice as ingredient.”.
New regulation 34A
9.  The Food Regulations are amended by inserting, immediately after regulation 34, the following regulation:
3-monochloropropane-1,2-diol (3-MCPD)
34A.  No person shall import, sell, advertise, manufacture, consign or deliver any soy sauce or oyster sauce containing 3-monochloropropane-1,2-diol (3-MCPD) in excess of 20 parts per billion, calculated on 40% dry matter content.”.
Amendment of regulation 37
10.  Regulation 37 of the Food Regulations is amended by deleting paragraph (1) and substituting the following paragraph:
(1)  No person shall import, sell, consign or deliver, or use or permit to be used in the preparation, packing, storage or delivery of, any food for sale if any package or container —
(a)contains more than 1 ppm of vinyl chloride monomer;
(b)yields, or is likely to yield, to its contents more than 0.01 ppm of vinyl chloride monomer; or
(c)yields, or is likely to yield, to its contents any compounds known to be carcinogenic, mutagenic or teratogenic or any other poisonous or injurious substance.”.
Amendment of Third Schedule
11.  Paragraph 1 of the Third Schedule to the Food Regulations is amended —
(a)by inserting, immediately below the last entry corresponding to item (a) of the table, the following entries corresponding thereto in the appropriate columns as shown hereunder:

12.  The Fourth Schedule to the Food Regulations is amended —

Amendment of Sixth Schedule
13.  The Sixth Schedule to the Food Regulations is amended by inserting, immediately after the item “Curdlan;”, the item “Cyclodextrins, alpha- and gamma-;”.
Amendment of Seventh Schedule
14.  The Seventh Schedule to the Food Regulations is amended by inserting, immediately after the entry “Ferric saccharate” under the item “IRON” in item 2 of Part II, the entry “Ferrous ammonium phosphate”.
Amendment of Eighth Schedule
15.  The Eighth Schedule to the Food Regulations is amended —
(a)by inserting, immediately below the item “Beeswax;”, the following item:
Beta-galactosidase (lactase from Kluyveromyces lactis);”;
(b)by inserting, immediately below the item “Glucono delta-lactone;”, the following item:
Glucose oxidase (from Aspergillus niger);”;
(c)by inserting, immediately below the item “Lactitol;”, the following items:
Lipase (triacylglycerol acylhydrolase from a genetically modified strain of Aspergillus niger);
Lipase, triacylglycerol (from a genetically modified strain of Aspergillus oryzae);”; and
(d)by inserting, immediately below the item “Propylene glycol;”, the following item:
Protease (from Bacillus subtilis);”.
