Amendment of Code of Practice for Competition in the Provision of Telecommunication Services

In exercise of the powers conferred by section 26(1) of the Telecommunications Act, the Info-communications Development Authority of Singapore hereby amends the Code of Practice for Competition in the Provision of Telecommunication Services, with effect from 29th September 2003, in the manner set out in paragraph 2.

2. The Code of Practice for Competition in the Provision of Telecommunication Services (G.N. No. S 412/2000) is amended —

(a)

by inserting, immediately after the words “approved by IDA” at the end of subsection 5.3, the words “The Dominant Licensee must offer the RIO to Requesting Licensees for a period of 3 years. By separate notice in the Gazette, IDA will specify the commencement date for the 3-year period. Thereafter, prior to the expiry of the 3-year period, IDA may by notice in the Gazette specify any further period of 3 years each for which the Dominant Licensee must offer the RIO to Requesting Licensees and the commencement date for such further 3-year period.”;

(b)

by deleting subsection 5.3.5.8 and substituting the following subsection:

“(5.3.5.8)

Modification and Duration of the Agreement

The Dominant Licensee must provide that: (a) unless IDA authorises the Dominant Licensee to withdraw its RIO and to terminate any Interconnection Agreement adopted pursuant to its RIO, the duration of any Interconnection Agreement arrived at by accepting the RIO shall be for such period as the Dominant Licensee is required to offer the RIO to Requesting Licensees under subsection 5.3 of this Code; and (b) the prices, terms and conditions contained in any Interconnection Agreement arrived at by accepting the RIO will be effective for the duration of the Interconnection Agreement unless either: (i) the Dominant and Requesting Licensees agree to modify their Interconnection Agreement pursuant to subsection 4.4.2 of this Code, or (ii) IDA directs the Dominant Licensee to modify any provision of its RIO, in which case the Licensees shall amend the Interconnection Agreement to conform to the modifications in the RIO.”;

(c)

by deleting the words “Unless modified or eliminated by IDA, the prices, terms and conditions specified in this Appendix will remain effective for 3 years from the effective date of this Code.” in paragraph 1.6 of Appendix Two; and

(d)

by deleting the words “prior to the end of 3 year period” in paragraph 1.6 of Appendix Two and substituting the words “at any time”.
