(Moving Generations)
(Exemption) Order 2018
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation
1.  This Order is the Active Mobility (Moving Generations) (Exemption) Order 2018.
Definitions
2.  In this Order —
“e‑trishaw” means a three‑wheeled pedal cycle that —
(a)is constructed or adapted for the carriage of passengers;
(b)is equipped with an electric motor; and
(c)may be propelled by human power or by the electric motor with which it is equipped, or by both;
“Moving Generations” means the event known as Moving Generations conducted —
(a)on the shared paths specified in Part 1 of the Schedule on 29 August 2018, from 11 a.m. to 3 p.m.;
(b)on the shared paths specified in Part 2 of the Schedule on 3 September 2018, from 10 a.m. to 3 p.m.;
(c)on the shared paths specified in Part 3 of the Schedule on 4 September 2018, from 10 a.m. to 3 p.m.; and
(d)on the footpaths specified in Part 4 of the Schedule on 7 September 2018, from 10 a.m. to 3 p.m.;
“organiser” means the company incorporated under the Companies Act (Cap. 50) as Cycling Without Age Singapore Ltd. (UEN No. 201714757N);
“specified e‑trishaw” means any e‑trishaw that is used by the organiser for the purpose of Moving Generations.
Exemption for specified e‑trishaws riders
3.  Sections 16 and 17 of the Act do not apply to an individual who rides a specified e‑trishaw on any footpath or shared path specified in Part 1, 2, 3 or 4 of the Schedule (as the case may be), in connection with Moving Generations, if all of the following conditions are satisfied:
(a)the specified e‑trishaw is ridden only during Moving Generations;
(b)the individual is authorised by the organiser to ride the specified e‑trishaw;
(c)the specified e‑trishaw is not ridden at a speed exceeding 10 km/h;
(d)no more than 10 specified e‑trishaws are used at any time on all of the footpaths or shared paths specified in Part 1, 2, 3 or 4 of the Schedule (as the case may be);
(e)the specified e‑trishaw is used to carry, at any time, no more than one driver and 2 passengers, but not for reward;
(f)all passengers on the specified e‑trishaw are safely secured;
(g)the specified e‑trishaw is not used to carry goods for hire or reward;
(h)there is in force, at any time the specified e‑trishaw is used in connection with Moving Generations, a policy of insurance in relation to the specified e‑trishaw, insuring against any liability in respect of the death of or bodily injury sustained by any person, or property damage suffered by any person, caused by or arising out of the use of the specified e‑trishaw.
