Paragraphs 5(1) and 6
Incidental and Consequential Provisions
Part I
bukit timah town council
1.  All the property, rights and liabilities comprised in the undertaking of the dissolved Town Council for the former Town of Bukit Timah to which that Town Council was entitled or subject immediately before 13th November 2001 shall become, by virtue of this Order and without further assurance —
(a)the property, rights and liabilities of the Town Council for the Town of Holland-Bukit Panjang where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Holland-Bukit Panjang;
(b)the property, rights and liabilities of the Town Council for the Town of Hong Kah where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Chua Chu Kang or Hong Kah;
(c)the property, rights and liabilities of the Town Council for the Town of Jurong where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Bukit Timah or Jurong; and
(d)the property, rights and liabilities of the Town Council for the Town of West Coast-Ayer Rajah where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Ayer Rajah or West Coast.
2.  All deeds, agreements, instruments and working arrangements subsisting immediately before 13th November 2001 affecting the undertaking of the dissolved Town Council transferred to the Town Council for the Town of Holland-Bukit Panjang, Hong Kah, Jurong or West Coast-Ayer Rajah under this Order shall continue in force on and after that date and shall be enforceable by or against the Town Council for the Town of Holland-Bukit Panjang, Hong Kah, Jurong or West Coast-Ayer Rajah, as the case may be, as if, instead of the dissolved Town Council, the Town Council for the Town of Holland-Bukit Panjang, Hong Kah, Jurong or West Coast-Ayer Rajah, as the case may be, had been named therein or had been a party thereof.
3.  Any proceedings or cause of action relating to the undertaking of the dissolved Town Council pending or existing immediately before 13th November 2001 by or against that dissolved Town Council may be continued and shall be enforced by or against the Town Council for the Town of Holland-Bukit Panjang, Hong Kah, Jurong or West Coast-Ayer Rajah, as the case may be.
Part II
Cheng San Town Council
1.  All the property, rights and liabilities comprised in the undertaking of the dissolved Town Council for the former Town of Cheng San to which that Town Council was entitled or subject immediately before 13th November 2001 shall become, by virtue of this Order and without further assurance —
(a)the property, rights and liabilities of the Town Council for the Town of Aljunied where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Aljunied;
(b)the property, rights and liabilities of the Town Council for the Town of Ang Mo Kio where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Ang Mo Kio; and
(c)the property, rights and liabilities of the Town Council for the Town of Pasir Ris-Punggol where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Pasir Ris-Punggol.
2.  All deeds, agreements, instruments and working arrangements subsisting immediately before 13th November 2001 affecting the undertaking of the dissolved Town Council transferred to the Town Council for the Town of Aljunied, Ang Mo Kio or Pasir Ris-Punggol, as the case may be, under this Order shall continue in force on and after that date and shall be enforceable by or against the Town Council for the Town of Aljunied, Ang Mo Kio or Pasir Ris-Punggol, as the case may be, as if, instead of the dissolved Town Council, the Town Council for the Town of Aljunied, Ang Mo Kio or Pasir Ris-Punggol, as the case may be, had been named therein or had been a party thereof.
3.  Any proceedings or cause of action relating to the undertaking of the dissolved Town Council pending or existing immediately before 13th November 2001 by or against that dissolved Town Council may be continued and shall be enforced by or against the Town Council for the Town of Aljunied, Ang Mo Kio or Pasir Ris-Punggol, as the case may be.
Part III
City Centre Town Council
1.  All the property, rights and liabilities comprised in the undertaking of the dissolved Town Council for the former Town of City Centre to which that Town Council was entitled or subject immediately before 13th November 2001 shall become, by virtue of this Order and without further assurance —
(a)the property, rights and liabilities of the Town Council for the Town of Holland-Bukit Panjang where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Holland-Bukit Panjang;
(b)the property, rights and liabilities of the Town Council for the Town of Jalan Besar where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Jalan Besar; and
(c)the property, rights and liabilities of the Town Council for the Town of Tanjong Pagar where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Tanjong Pagar.
2.  All deeds, agreements, instruments and working arrangements subsisting immediately before 13th November 2001 affecting the undertaking of the dissolved Town Council transferred to the Town Council for the Town of Holland-Bukit Panjang, Jalan Besar or Tanjong Pagar under this Order shall continue in force on and after that date and shall be enforceable by or against the Town Council for the Town of Holland-Bukit Panjang, Jalan Besar or Tanjong Pagar, as the case may be, as if, instead of the dissolved Town Council, the Town Council for the Town of Holland-Bukit Panjang, Jalan Besar or Tanjong Pagar, as the case may be, had been named therein or had been a party thereof.
3.  Any proceedings or cause of action relating to the undertaking of the dissolved Town Council pending or existing immediately before 13th November 2001 by or against that dissolved Town Council may be continued and shall be enforced by or against the Town Council for the Town of Holland-Bukit Panjang, Jalan Besar or Tanjong Pagar, as the case may be.
Part IV
Pasir Ris
1.  All the property, rights and liabilities comprised in the undertaking of the dissolved Town Council for the former Town of Pasir Ris to which that Town Council was entitled or subject immediately before 13th November 2001 shall become, by virtue of this Order and without further assurance —
(a)the property, rights and liabilities of the Town Council for the Town of Aljunied where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Aljunied;
(b)the property, rights and liabilities of the Town Council for the Town of Pasir Ris-Punggol where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Pasir Ris-Punggol; and
(c)the property, rights and liabilities of the Town Council for the Town of Tampines where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Tampines.
2.  All deeds, agreements, instruments and working arrangements subsisting immediately before 13th November 2001 affecting the undertaking of the dissolved Town Council transferred to the Town Council for the Town of Aljunied, Pasir Ris-Punggol or Tampines under this Order shall continue in force on and after that date and shall be enforceable by or against the Town Council for the Town of Aljunied, Pasir Ris-Punggol or Tampines, as the case may be, as if, instead of the dissolved Town Council, the Town Council for the Town of Aljunied, Pasir Ris-Punggol or Tampines, as the case may be, had been named therein or had been a party thereof.
3.  Any proceedings or cause of action relating to the undertaking of the dissolved Town Council pending or existing immediately before 13th November 2001 by or against that dissolved Town Council may be continued and shall be enforced by or against the Town Council for the Town of Aljunied, Pasir Ris-Punggol or Tampines, as the case may be.
Part V
Tanjong Pagar-west Coast
1.  All the property, rights and liabilities comprised in the undertaking of the dissolved Town Council for the former Town of Tanjong Pagar-West Coast to which that Town Council was entitled or subject immediately before 13th November 2001 shall become, by virtue of this Order and without further assurance —
(a)the property, rights and liabilities of the Town Council for the Town of Holland-Bukit Panjang where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Holland-Bukit Panjang;
(b)the property, rights and liabilities of the Town Council for the Town of Tanjong Pagar where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of Tanjong Pagar; and
(c)the property, rights and liabilities of the Town Council for the Town of West Coast-Ayer Rajah where such property, rights and liabilities related to or were connected with any area of the former Town now comprised in the constituency of West Coast.
2.  All deeds, agreements, instruments and working arrangements subsisting immediately before 13th November 2001 affecting the undertaking of the dissolved Town Council transferred to the Town Council for the Town of Holland-Bukit Panjang, Tanjong Pagar or West Coast-Ayer Rajah under this Order shall continue in force on and after that date and shall be enforceable by or against the Town Council for the Town of Holland-Bukit Panjang, Tanjong Pagar or West Coast-Ayer Rajah, as the case may be, as if, instead of the dissolved Town Council, the Town Council for the Town of Holland-Bukit Panjang, Tanjong Pagar or West Coast-Ayer Rajah, as the case may be, had been named therein or had been a party thereof.
3.  Any proceedings or cause of action relating to the undertaking of the dissolved Town Council pending or existing immediately before 13th November 2001 by or against that dissolved Town Council may be continued and shall be enforced by or against the Town Council for the Town of Holland-Bukit Panjang, Tanjong Pagar or West Coast-Ayer Rajah, as the case may be.
