(Temporary Exemption) Order 2020
In exercise of the powers conferred by section 47 of the Shared Mobility Enterprises (Control and Licensing) Act 2020, the Minister for Transport makes the following Order:
Citation and commencement
1.  This Order is the Shared Mobility Enterprises (Control and Licensing) (Temporary Exemption) Order 2020 and comes into operation on 22 July 2020.
Definitions
2.  In this Order, unless the context otherwise requires —
“motorised personal mobility device” means a personal mobility device other than a non‑motorised personal mobility device;
“non‑motorised personal mobility device” means a personal mobility device that is designed to be propelled by human power only;
“power‑assisted bicycle” means a bicycle that is equipped with an electric motor, and may be propelled by human power or by the electric motor with which it is equipped or by both;
“vehicle” means a bicycle, personal mobility device, power-assisted bicycle or mobility vehicle.
Providing docked vehicle for hire
3.—(1)  Sections 8 and 9 of the Act do not apply to a person who provides in the course of business —
(a)a service using motorised personal mobility devices or power‑assisted bicycles, or a combination of such vehicles, under which an individual can —
(i)hire a docked motorised personal mobility device or docked power‑assisted bicycle to ride on wholly or partly in a public place; and
(ii)end the hiring of the motorised personal mobility device or power‑assisted bicycle docked in or at any place, whether or not a public place; or
(b)a service using bicycles, non-motorised personal mobility devices or mobility vehicles, or a combination of such vehicles, under which an individual can —
(i)hire a docked bicycle, docked non‑motorised personal mobility device or docked mobility vehicle to ride on wholly or partly in a public place; and
(ii)end the hiring of the bicycle, non‑motorised personal mobility device or mobility vehicle (as the case may be) docked in or at any place, whether or not a public place.
(2)  The exemption in sub‑paragraph (1)(a) ends on (and includes) 31 March 2021.
Facilitating making and taking of bookings of vehicles for hire
4.  Sections 8 and 9 of the Act do not apply to a person who provides in the course of business a service that involves facilitating the making and taking of bookings by an individual —
(a)to hire on‑demand a vehicle when it is standing or exposed undocked in a public place for hire by the general public —
(i)to ride on wholly or partly in a public place; and
(ii)to end the hiring of the vehicle undocked in or at any public place;
(b)to hire on‑demand a vehicle when it is standing or exposed undocked (whether or not in a public place) for hire by the general public or otherwise —
(i)to ride on wholly or partly in a public place; and
(ii)to end the hiring of the vehicle either undocked or docked in or at any place, whether or not a public place; or
(c)to hire a docked vehicle to ride on wholly or partly in a public place, and to end the hiring of the vehicle either undocked or docked in or at any place, whether or not a public place.
