(Motor Vehicles, Driving Licences)
(Amendment) Rules 2018

In exercise of the powers conferred by section 48 of the Road Traffic Act, the Minister for Home Affairs makes the following Rules:

Citation and commencement

1. These Rules are the Road Traffic (Motor Vehicles, Driving Licences) (Amendment) Rules 2018 and come into operation on 1 October 2018.

Amendment of rule 3

2. Rule 3 of the Road Traffic (Motor Vehicles, Driving Licences) Rules (R 27) (called in these Rules the principal Rules) is amended —

(a)

by deleting paragraph (2) and substituting the following paragraphs:

“(2) An application for the grant of a driving licence must be accompanied by one photograph of the applicant.

(2A) An application for the renewal of a driving licence must, if so required by the Deputy Commissioner of Police or authorised officer, be accompanied by one photograph of the applicant.”; and

(b)

by deleting the words “paragraph (2)” in paragraphs (3) and (5)(a) and substituting in each case the words “paragraphs (2) and (2A)”.

Amendment of rule 25

3. Rule 25 of the principal Rules is amended by inserting, immediately after paragraph (1), the following paragraphs:

“(1A) An application for a replacement licence must, if so required by the Deputy Commissioner of Police, be accompanied by one photograph of the applicant.

(1B) The photograph mentioned in paragraph (1A) must comply with the specifications set out in the Ninth Schedule.”.

Amendment of Ninth Schedule

4. The Ninth Schedule to the principal Rules is amended —

(a)

by deleting the Schedule reference and substituting the following Schedule reference:

“Rules 3(3) and (5)(b)(i) and 25(1B)”;

(b)

by deleting the word “months” in paragraph (1) and substituting the word “years”; and

(c)

by inserting, immediately after the word “colour” in paragraph (5), the words “and, if in hard copy form,”.

Saving provision

5. The principal Rules as in force immediately before 1 October 2018 continue to apply in relation to —

(a)	any application under rule 3 of those Rules for the grant or renewal of a licence made before that date; and
(b)	any application under rule 25 of those Rules for a replacement licence made before that date.
