Misuse of Drugs
(Amendment No. 2)
Regulations 2018

In exercise of the powers conferred by section 58(1) of the Misuse of Drugs Act, the Minister for Home Affairs makes the following Regulations:

Citation and commencement

1. These Regulations are the Misuse of Drugs (Amendment No. 2) Regulations 2018 and come into operation on 1 October 2018.

Amendment of Fourth Schedule

2. Paragraph 17 of the Fourth Schedule to the Misuse of Drugs Regulations (Rg 1) is amended —

(a)

by inserting, immediately after item (6E), the following item:

“(6F)

[1-(5-Bromopent-1-yl)-1H-indazol-3-yl](naphthalen-1‑yl)methanone (also known as 5-Bromo-THJ-018) and its bromo positional isomers in the pentyl group”;

(b)

by inserting, immediately after item (8AB), the following item:

“(8AC)

[1-(5-Chloropent-1-yl)-1H-indazol-3-yl](naphthalen-1-yl)methanone (also known as 5-Chloro-THJ-018) and its chloro positional isomers in the pentyl group”;

(c)

by inserting, immediately after item (19), the following item:

“(19AAA)

Ethyl 2-[1-(4-fluorobenzyl)-1H-indazole-3‑carboxamido]-3-methylbutanoate (also known as EMB-FUBINACA or AEB-FUBINACA or FUB-AEB) and its pentanoate isomers and their respective fluoro positional isomers in the phenyl ring”;

(d)

by inserting, immediately after item (19AA), the following item:

“(19ABA)

2-[1-(4-Fluorobenzyl)-1H-indazole-3-carboxamido]-3‑methylbutanoic acid and its 1-pentanoic acid and 2‑methylbutanoic acid isomers and their respective fluoro positional isomers in the phenyl ring”;

(e)

by inserting, immediately after item (27), the following item:

“(27AA)

[1-(5-Hydroxypent-1-yl)-1H-indazol-3-yl](naphthalen-1-yl)methanone and its hydroxy positional isomers in the pentyl group”;

(f)

by inserting, immediately after item (27D), the following item:

“(27DA)

[1-(5-Iodopent-1-yl)-1H-indazol-3-yl](naphthalen-1-yl)methanone (also known as 5-Iodo-THJ-018) and its iodo positional isomers in the pentyl group”;

(g)

by deleting item (32) and substituting the following item:

“(32)

(N-Methyl-4-phenylpiperidin-4-yl)propanoate (also known as 1-Methyl-4-phenyl-4-piperidinol propionate, desmethylprodine or MPPP)”;

(h)

by inserting, immediately after item (36B), the following item:

“(36C)

5-[3-(1-Naphthoyl)-1H-indazol-1-yl]-pentanoic acid”; and

(i)

by inserting, immediately after item (38), the following item:

“(38AA)

4-Phenyl-N-(2-phenylethyl)piperidin-4-yl acetate (also known as 1-Phenethyl-4-phenyl-4-piperidinol acetate or PEPAP)”.
