Town Council of Marine Parade
(Common Property and Open Spaces)
(Amendment) By-laws 2019
In exercise of the powers conferred by section 24 of the Town Councils Act, the Town Council for the Town of Marine Parade makes the following By‑laws:
Citation and commencement
1.  These By-laws are the Town Council of Marine Parade (Common Property and Open Spaces) (Amendment) By‑laws 2019 and come into operation on 1 September 2019.
Amendment of by-law 2
2.  By-law 2 of the Town Council of Marine Parade (Common Property and Open Spaces) By‑laws (By 28) (called in these By‑laws the principal By‑laws) is amended —
(a)by inserting, immediately after the definition of “housing estate” in paragraph (1), the following definition:
“ “mobility aid” means any of the following carrying an individual who is unable to walk or has difficulty in walking:
(a)a wheelchair (motorised or otherwise);
(b)a mobility scooter as defined by the Active Mobility Act 2017 (Act 3 of 2017);”;
(b)by inserting, immediately after the definition of “parking place” in paragraph (1), the following definition:
“ “public path” means a path declared under section 6 of the Active Mobility Act 2017 as a public path;”;
(c)by inserting, immediately after the words “on the road” in the definition of “vehicle” in paragraph (1), the words “, such as (but not limited to) a bicycle, power‑assisted bicycle or personal mobility device as defined by the Active Mobility Act 2017, but excludes any mobility aid”; and
(d)by inserting, immediately after paragraph (2), the following paragraph:
(3)  These By‑laws do not affect the rights of the public to pass along a public path within the Town of Marine Parade in accordance with the Active Mobility Act 2017.”.
Amendment of by-law 3
3.  By-law 3 of the principal By‑laws is amended —
(a)by deleting the words “a wheel‑chair used solely for the conveyance of a person suffering from some physical defect or disability” in paragraph (b) and substituting the words “a mobility aid”; and
(b)by renumbering the by‑law as paragraph (1) of that by‑law, and by inserting immediately thereafter the following paragraph:
(2)  Paragraph (1)(b) does not apply to —
(a)a perambulator;
(b)a child’s toy vehicle used solely by a child;
(c)a mobility aid; or
(d)any common property or open space that is a public path within the Town of Marine Parade.”.
Amendment of by-law 4
4.  By-law 4 of the principal By‑laws is amended —
(a)by deleting the word “abandoned” in paragraph (6);
(b)by deleting the words “7 days of the date of its detention or immobilisation, the secretary may, after giving one month’s notice in the Gazette of his intention to do so, sell the vehicle by public auction or otherwise dispose of it in such manner as he thinks fit” in paragraph (6) and substituting the words “30 days after the date notice is given under paragraph (2) of the removal or immobilisation (as the case may be), the Town Council may sell the vehicle or otherwise dispose of it”; and
(c)by deleting the words “an abandoned” in paragraph (7) and substituting the word “any”.
Savings
5.  Despite by-law 4, by‑law 4 of the principal By‑laws as in force immediately before 1 September 2019 continues to apply to and in relation to any vehicle removed or immobilised before that date under that by‑law 4 as if these By‑laws were not enacted.
