Town Council of Tampines
(Common Property and Open Spaces)
(Amendment) By-laws 2019
In exercise of the powers conferred by section 24 of the Town Councils Act, the Town Council for the Town of Tampines makes the following By‑laws:
Citation and commencement
1.  These By-laws are the Town Council of Tampines (Common Property and Open Spaces) (Amendment) By‑laws 2019 and come into operation on 1 September 2019.
Amendment of by-law 2
2.  By‑law 2 of the Town Council of Tampines (Common Property and Open Spaces) By‑laws (By 35) (called in these By‑laws the principal By‑laws) is amended —
(a)by deleting the definition of “bicycle” in paragraph (1) and substituting the following definitions:
“ “bicycle”, “mobility scooter”, “motorised wheelchair”, “personal mobility device” and “power‑assisted bicycle” have the respective meanings given by the Active Mobility Act 2017 (Act 3 of 2017);”;
(b)by inserting, immediately after the words “the use of a cyclist” in the definition of “bicycle path” in paragraph (1), the words “and that is not a public path”;
(c)by inserting, immediately after the words “as a means of access” in the definition of “footway” in paragraph (1), the words “and that is not a public path”;
(d)by inserting, immediately after the definition of “housing estate” in paragraph (1), the following definition:
“ “mobility aid” means any of the following carrying an individual who is unable to walk or has difficulty in walking:
(a)a wheelchair or motorised wheelchair;
(b)a mobility scooter;”;
(e)by deleting the definition of “power‑assisted bicycle” in paragraph (1) and substituting the following definition:
“ “public path” means a path declared under section 6 of the Active Mobility Act 2017 as a public path;”;
(f)by inserting, immediately after the words “on the road” in the definition of “vehicle” in paragraph (1), the words “, such as (but not limited to) a bicycle, power‑assisted bicycle or personal mobility device, but excludes any mobility aid”; and
(g)by inserting, immediately after paragraph (2), the following paragraph:
(3)  These By-laws do not affect the rights of the public to pass along a public path within the Town of Tampines in accordance with the Active Mobility Act 2017.”.
Amendment of by-law 3
3.  By‑law 3 of the principal By‑laws is amended —
(a)by deleting the words “, bicycle or power‑assisted bicycle” in paragraph (1)(a);
(b)by deleting the words “a wheel‑chair used solely for the conveyance of persons suffering from some physical defect or disability” in paragraph (1)(b) and substituting the words “a mobility aid,”;
(c)by inserting, immediately after paragraph (4), the following paragraph:
(5)  Paragraphs (1)(b), (3) and (4) do not apply to or in relation to any common property or open space that is a public path within the Town of Tampines.”; and
(d)by deleting the words “bicycles, etc.” in the by‑law heading and substituting the word “vehicles”.
Amendment of by-law 4
4.  By‑law 4 of the principal By‑laws is amended —
(a)by deleting the words “, bicycle or power‑assisted bicycle” wherever they appear in paragraphs (1), (2) and (3);
(b)by inserting, immediately after paragraph (3), the following paragraphs:
(4)  If the owner of the detained or removed vehicle, or the person who had lawful possession of the vehicle when it was detained or removed, does not claim the vehicle within 30 days after the date notice is given under paragraph (1)(a) or (2) of the detention or removal, as the case may be, the Town Council may sell the vehicle or otherwise dispose of it.
(5)  The Town Council may apply the proceeds of the sale or disposal of the vehicle to meet the expenses reasonably incurred by the Town Council in the detention, removal, sale or disposal of the vehicle under this by‑law, before paying the balance (if any) of the proceeds to the owner of the vehicle.”; and
(c)by deleting the words “, bicycles and power‑assisted bicycles” in the by‑law heading.
Deletion of by-law 20
5.  By-law 20 of the principal By-laws is deleted.
Savings
6.  Despite by‑law 4, by‑law 4 of the principal By‑laws as in force immediately before 1 September 2019 continues to apply to and in relation to any vehicle detained or removed before that date under by‑law 4 of the principal By‑laws as if these By‑laws were not enacted.
