Town Councils Act

Town Council of Bishan-toa Payoh (Conservancy and Service Charges) (Amendment No. 2) By-laws 2003
In exercise of the powers conferred by section 24(1) of the Town Councils Act, the Town Council for the Town of Bishan-Toa Payoh hereby makes the following By-laws:
Citation and commencement
1.  These By-laws may be cited as the Town Council of Bishan-Toa Payoh (Conservancy and Service Charges) (Amendment No. 2) By-laws 2003 and shall come into operation on 1st January 2004.
New by-law 2A
2.  The Town Council of Bishan-Toa Payoh (Conservancy and Service Charges) By-laws (By 68) is amended by inserting, immediately after by-law 2, the following by-law:
Deposit for commercial property
2A.—(1)  Every owner or tenant of any commercial property of the Board within the Town of Bishan-Toa Payoh shall, where such owner or tenant is a limited company within the meaning of section 4 of the Companies Act (Cap. 50), pay to the Town Council upon commencement or renewal of the lease a deposit equal to 2 months of the conservancy and service charges payable in respect of that commercial property.
(2)  Where any lease of a commercial property is for any reason terminated before its expiry, the Town Council may deduct from the deposit such amount as may be required to pay any outstanding debt owing to the Town Council.
(3)  The Town Council shall, upon the expiry or earlier termination of the lease, return the whole deposit without interest or, if a deduction was made under paragraph (2), the balance of the deposit, to the owner or tenant.”.
Amendment of Schedule
3.  The Schedule to the Town Council of Bishan-Toa Payoh (Conservancy and Service Charges) By-laws is amended by deleting items 10 to 13 and substituting the following items:
10. Shop with living accommodation which —
 
 
(a) closes its business by midnight
 
$1.58 per square metre of the area of the shop subject to a minimum of $50.40 in addition to the following conservancy and service charges for the equivalent room type:
(i)  1-room flat
 
$19.95.
(ii)  2-room flat
 
$29.40.
(iii)  3-room flat
 
$40.43.
(iv)  4-room flat
 
$52.50.
(v)  5-room flat
 
$63.00.
(b) remains open for business after midnight
 
$3.15 per square metre of the area of the shop subject to a minimum of $100.80 in addition to the following conservancy and service charges for the equivalent room type:
(i)  1-room flat
 
$19.95.
(ii)  2-room flat
 
$29.40.
(iii)  3-room flat
 
$40.43.
(iv)  4-room flat
 
$52.50.
(v)  5-room flat
 
$63.00.
11. Shop without living accommodation which —
 
 
(a) closes its business by midnight
 
$1.58 per square metre of the area of the shop subject to a minimum of $50.40.
(b) remains open for business after midnight
 
$3.15 per square metre of the area of the shop subject to a minimum of $100.80.
12. Kiosk or shoplet
 
$1.58 per square metre of the area of the premises subject to a minimum of $50.40.
13. Stall:
 
 
(a) Cooked food stall
 
$13.65 per square metre or part thereof of the area of the stall subject to a minimum of $136.50 for the first 10 square metres.
(b) Fruit, preserved and dried goods, fresh fish and seafood, meat or poultry stall
 
$7.35 per square metre or part thereof of the area of the stall subject to a minimum of $73.50 for the first 10 square metres.
(c) Vegetable, bean curd and noodle, eggs, ground assorted spices or miscellaneous stall
 
$4.20 per square metre or part thereof of the area of the stall subject to a minimum of $42.00 for the first 10 square metres.
(d) Piece and sundry stall
 
$8.40 per square metre or part thereof of the area of the stall subject to a minimum of $84.00 for the first 10 square metres.
