(Composition of Offences)
(Amendment) Rules 2024

In exercise of the powers conferred by section 82(3) of the Air Navigation Act 1966, the Minister for Transport makes the following Rules:

Citation and commencement

1.—(1) These Rules are the Air Navigation (Composition of Offences) (Amendment) Rules 2024 and, except for rules 2(a) and (c) and 3(a), come into operation on 1 August 2024.

(2) Rules 2(a) and (c) and 3(a) are deemed to have come into operation on 31 December 2021.

Amendment of rule 2

2. In the Air Navigation (Composition of Offences) Rules 2017 (G.N. No. S 667/2017) (called in these Rules the principal Rules), in rule 2 —

(a)

replace “28A(4)(a)” with “82(5)(a)”;

(b)

delete paragraph (d);

(c)

in paragraph (e), replace “17E(1) or (2), read with section 17E(4)” with “68(1) or (2), read with section 68(4)”;

(d)

in paragraph (e), replace the full‑stop at the end with a semi‑colon; and

(e)

after paragraph (e), insert —

“(f)	an offence under section 67(3) of the Act;
(g)	an offence under regulation 14(2) of the Air Navigation (Licensing of Air Services) Regulations (Rg 2).”.

Amendment of rule 3

3. In the principal Rules, in rule 3 —

(a)

replace “28A(4)(b)” with “82(5)(b)”;

(b)

in paragraph (a)(i), after “(O 2)”, insert “as in force immediately before 1 January 2023”;

(c)

in paragraph (a)(xiii), replace “50G(1) or (2), 50H(3) or 64H” with “50G(1) or (2) or 50H(3) as in force immediately before 1 January 2023, or 64H”;

(d)

in paragraph (a), delete sub‑paragraph (xiv);

(e)

in paragraph (a)(xv), delete “or” at the end;

(f)

in paragraph (a)(xvi), replace “4(3A)” with “14(3)”;

(g)

in paragraph (a), after sub‑paragraph (xvi), insert —

“(xvii)	regulation 5(1) of the Air Navigation (92 — Carriage of Dangerous Goods) Regulations 2022 (G.N. No. S 998/2022), read with section 14(3) of the Act; or
(xviii)	regulation 10(7), 11(2), 12(3) or (4), 14(3), 16(3), 17(5) or (6), 18(4) or (5), 19(3) or (4), 22(2), 23(2), 24(7), (8) or (9) or 25(4) or (5) of the Air Navigation (92 — Carriage of Dangerous Goods) Regulations 2022;”;

(h)

in the following provisions, after “Order”, insert “as in force immediately before 1 January 2023”:

Saving provision

4. Despite rule 3(d), rule 3(a)(xiv) of the principal Rules as in force before the date of commencement of these Rules continues to apply in relation to any offence reasonably suspected to have been committed before that date under paragraph 72E(1), 72F(1), (2) or (3) or 72J, read with paragraph 80(5), of the Air Navigation Order (O 2).
