Arms and Explosives
(Exemption) (No. 2) Order 2015
In exercise of the powers conferred by section 44B of the Arms and Explosives Act, the Minister for Home Affairs makes the following Order:
Citation and commencement
1.—(1)  This Order may be cited as the Arms and Explosives (Exemption) (No. 2) Order 2015.
(2)  The period for which this Order is in force starts on 26 November 2015 and ends at 2359 hours on 16 December 2015.
Definitions
2.—(1)  In this Order, unless the context otherwise requires —
“approved premises” means any premises approved by the relevant authority to carry out the servicing and repair of any air‑gun for the purpose of the ASEAN Para Games 2015;
“approved shooting range” means any shooting range approved by the relevant authority for the use of any air‑gun at the ASEAN Para Games 2015;
“approved storage premises” means any storage premises approved by the relevant authority to store any air‑gun for the purpose of the ASEAN Para Games 2015;
“ASEAN Para Games 2015” means the 8th ASEAN Para Games 2015 to be held in Singapore from 3 December 2015 to 9 December 2015 (both dates inclusive);
“first point of arrival” means the location where an air‑gun intended to be used for the purpose of the ASEAN Para Games 2015 is first received in Singapore by the Singapore Shooting Association, or an officer of the Association authorised by the Association;
“point of final export” means the location where an air‑gun used or intended to be used for the purpose of the ASEAN Para Games 2015 is to be exported out of Singapore by a freight forwarder approved by the Singapore Shooting Association, or an officer of the Association authorised by the Association;
“relevant authority” means the Officer‑in‑Charge, Licensing (General Licensing), Police Licensing and Regulatory Department of the Singapore Police Force;
“Singapore Shooting Association” means the society registered in the name “Singapore Shooting Association, The” under the Societies Act (Cap. 311).
(2)  In this Order, a reference to an air‑gun being —
(a)possessed or controlled; or
(b)used or intended to be used,
for the purpose of any competition involving air‑guns at the ASEAN Para Games 2015, includes a reference to the air‑gun being possessed or controlled, or used or intended to be used (as the case may be) for any related purpose connected to such a competition.
Exemption for athletes and coaches
3.—(1)  Subject to sub‑paragraph (2), every athlete participating in the ASEAN Para Games 2015 and the athlete’s coach are exempt from the requirement under section 13 of the Act to have a licence for the possession or control of an air‑gun if the possession or control of the air‑gun is for the sole purpose of the athlete’s participation in any competition involving air‑guns at the ASEAN Para Games 2015.
(2)  The exemption under sub‑paragraph (1) only applies if the athlete or the athlete’s coach possesses or controls any such air‑gun at an approved shooting range.
Exemption for authorised persons servicing or repairing air‑gun
4.—(1)  Subject to sub‑paragraph (2), a person who is authorised by the relevant authority to undertake the servicing or repair of an air‑gun is exempt from the requirement under section 13 of the Act to have a licence for the possession or control of an air‑gun if the possession or control of the air‑gun is for the purpose of any competition involving air‑guns at the ASEAN Para Games 2015.
(2)  The exemption under sub‑paragraph (1) only applies if —
(a)the air‑gun is serviced or repaired at the approved premises;
(b)the person maintains, in such form as the relevant authority may determine, a register containing the particulars of each air‑gun serviced or repaired, and such other particulars as the relevant authority may require; and
(c)the register is available for inspection by the relevant authority at any reasonable time.
Exemption for persons storing air‑gun
5.—(1)  Subject to sub‑paragraph (2), a person storing an air‑gun is exempt from the requirement under section 13 of the Act to have a licence for the possession or control of an air‑gun if the possession or control of the air‑gun is for the purpose of any competition involving air‑guns at the ASEAN Para Games 2015.
(2)  The exemption under sub‑paragraph (1) only applies if —
(a)the person is approved by the Singapore Shooting Association, or an officer of the Association authorised by the Association, to store the air‑gun for the purpose specified in sub‑paragraph (1);
(b)the air‑gun is stored securely at the approved storage premises;
(c)the person maintains, in such form as the relevant authority may determine, a register containing particulars relating to every movement of the air‑gun into or out of the approved storage premises, and such other particulars as the relevant authority may require; and
(d)the register is available for inspection by the relevant authority at any reasonable time.
Exemption for transporters
6.—(1)  Subject to sub‑paragraph (2), a person transporting an air‑gun is exempt from the requirement under section 13 of the Act to have a licence for the possession or control of the air‑gun if the possession or control of the air‑gun is for the purpose of any competition involving air‑guns at the ASEAN Para Games 2015.
(2)  The exemption under sub‑paragraph (1) only applies if —
(a)the air‑gun is transported directly (and without detour) —
(i)from the first point of arrival to an approved storage premises;
(ii)from an approved storage premises to the point of final export; or
(iii)from an approved storage premises to an approved shooting range and vice versa;
(b)the person is approved by the Singapore Shooting Association, or an officer of the Association authorised by the Association, to transport the air‑gun for the purpose specified in sub‑paragraph (1); and
(c)the air‑gun is escorted at all times during transport by one or more auxiliary police officers within the meaning of the Police Force Act (Cap. 235).
Exemption for Singapore Shooting Association
7.  The Singapore Shooting Association is exempt from the requirement under section 13 of the Act to have a licence to import or export an air‑gun, or to deal in an air‑gun, if the air‑gun is used or intended to be used for the purpose of any competition involving air‑guns at the ASEAN Para Games 2015.
Exemption for approved freight forwarders
8.—(1)  Subject to sub‑paragraph (2), a freight forwarder is exempt from the requirement under section 13 of the Act to have a licence for the import or export of an air‑gun if the air‑gun is used or intended to be used for the purpose of any competition involving air‑guns at the ASEAN Para Games 2015.
(2)  The exemption under sub‑paragraph (1) only applies if —
(a)the freight forwarder is approved by the Singapore Shooting Association, or an officer of the Association authorised by the Association, to import or export the air‑gun for the purpose specified in sub‑paragraph (1); and
(b)the air‑gun is exported after the completion of any competition involving air‑guns at the ASEAN Para Games 2015 without delay, and in any case not later than 2359 hours on 16 December 2015.
