PLANNING (TEMPORARY DEVELOPMENT LEVY — EXEMPTION) (AMENDMENT) RULES 2004

In exercise of the powers conferred by section 40D of the Planning Act, the Minister for National Development hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Planning (Temporary Development Levy — Exemption) (Amendment) Rules 2004 and shall come into operation on 28th October 2004.

Amendment of rule 2

2. Rule 2(1) of the Planning (Temporary Development Levy — Exemption) Rules 2003 (G.N. No. S 578/2003) is amended —

(a)

by inserting, immediately after the definition of “Housing and Development Board living quarter”, the following definition:

“ “industrial retail building” has the same meaning as in the Planning (Use Classes) Rules (R 2);”; and

(b)

by deleting the full-stop at the end of the definition of “temporary permission” and substituting a semi-colon, and by inserting immediately thereafter the following definition:

“ “warehouse retail building” has the same meaning as in the Planning (Use Classes) Rules.”.

Amendment of rule 4

3. Rule 4 of the Planning (Temporary Development Levy — Exemption) Rules 2003 is amended —

(a)

by deleting the words “paragraph (2)” in the 1st line of paragraph (1) and substituting the words “paragraphs (2) and (3)”; and

(b)

by inserting, immediately after paragraph (2), the following paragraph:

“(3) The exemption in paragraph (1) shall not apply in any development of land which involves a material change in the use of the land to an industrial retail building or a warehouse retail building.”.
