(Carriage of Persons in Goods Vehicles)
Rules 2010
In exercise of the powers conferred by section 77(6) of the Road Traffic Act, the Land Transport Authority of Singapore hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Carriage of Persons in Goods Vehicles) Rules 2010 and shall come into operation on 4th November 2010.
Only bona fide attendants to be carried
2.  No person shall be carried in a trailer other than bona fide attendants for the purpose of attending to the trailer and the number of such attendants shall not exceed those prescribed in section 77(1) and (2) of the Act.
Prohibition of persons to be carried on floor of vehicle unless all passenger seats have been filled up
3.  Subject to rules 5(1) and 8(2), no person shall be carried on the floor of a goods vehicle which has an open deck for the carriage of goods, whether such person is seated or otherwise, unless every passenger seat provided in the driver’s cabin, or any additional cabin or enclosed space provided for the carriage of passengers or goods and which is adjacent to or is an extension of the cabin for the driver, is filled up.
Safety of persons carried in goods vehicles
4.—(1)  No passenger shall, while being carried on or being permitted to ride on a goods vehicle, allow any part of his body to project beyond the side of the vehicle.
(2)  Subject to rule 7, no person shall drive, or cause or permit a person to drive, a goods vehicle while any person is standing in it.
(3)  No person shall drive, or cause or permit a person to drive, a goods vehicle which is carrying any load if the load is in such position that danger is likely to be caused to any passenger riding on the goods vehicle by reason of the load or any part thereof falling onto the passenger.
(4)  No person shall drive, or cause or permit a person to drive, a goods vehicle which has no open deck for the carriage of goods while carrying any passengers seated in or on any part of the vehicle if the height of the passenger, when sitting, exceeds 3.2 metres from the road surface upon which the goods vehicle rests.
(5)  No owner of a goods vehicle shall allow the goods vehicle to be driven in contravention of paragraph (2), (3) or (4).
Height restriction for persons carried on open deck goods vehicle
5.—(1)  No person shall drive, or cause or permit a person to drive, a goods vehicle which has an open deck for the carriage of goods if the height of the passenger, when sitting, exceeds 1.1 metres from the deck of the vehicle.
(2)  No owner of a goods vehicle shall allow the goods vehicle to be driven in contravention of paragraph (1).
Carriage of person for hire or reward
6.  Nothing in these Rules shall be deemed to authorise the carriage of any person for hire or reward on any goods vehicle.
Standing in a moving vehicle
7.  No person other than a permitted attendant shall stand in a goods vehicle whilst the vehicle is in motion.
Computation of number of persons carried
8.—(1)  In the case of any goods vehicle which has no open deck for the carriage of goods, no person shall drive, or cause or permit a person to drive, a goods vehicle carrying passengers if the clear floor space of the deck available for each passenger is less than 0.372 square metres.
(2)  In the case of any goods vehicle which has an open deck for the carriage of goods, no person shall drive, or cause or permit a person to drive, a goods vehicle carrying passengers during such period specified in sub-paragraph (a) or (b) if the clear floor space of the open deck available for each passenger is less than —
(a)0.372 square metres, for the period between 4th November 2010 and 31st July 2011 (both dates inclusive); and
(b)0.744 square metres, for the period on or after 1st August 2011.
(3)  No owner of a goods vehicle shall allow the goods vehicle to be driven in contravention of paragraph (1) or (2).
Marking of passenger capacity on goods vehicles
9.—(1)  No person shall be carried on the floor of a goods vehicle unless a marking or label stating the maximum passenger capacity of the floor of the vehicle as computed in accordance with rule 8 is painted or marked or otherwise clearly displayed at the right side of the rear tailboard of the vehicle or upon some conspicuous place on the vehicle determined by the Registrar.
(2)  The marking or label referred to in paragraph (1) shall —
(a)in the case of a goods vehicle which has an open deck for the carriage of goods —
(i)conform to the specifications set out in Diagram 1 of the Schedule if the vehicle is registered before 1st January 2010 but is used for the carriage of passengers between 4th November 2010 and 31st July 2011 (both dates inclusive);
(ii)conform to the specifications set out in Diagram 2 of the Schedule if the vehicle is registered before 1st January 2010 but is used for the carriage of passengers on or after 1st August 2011; or
(iii)conform to the specifications set out in Diagram 2 of the Schedule if the vehicle is registered on or after 1st January 2010 and is used for the carriage of passengers; and
(b)in the case of any other goods vehicle, conform to the specifications set out in Diagram 1 of the Schedule.
(3)  Where the marking or label of a goods vehicle referred to in paragraph (1) is altered or defaced such that it no longer conforms to the specifications referred to in paragraph (2) —
(a)the owner of the goods vehicle; and
(b)any person who alters or defaces the marking or label,
shall be guilty of an offence.
(4)  In any proceedings for an offence under paragraph (3)(a), it shall be a defence for the defendant to prove that another person had altered or defaced the marking or label without his consent or connivance.
(5)  A defendant shall not, without leave of the court, be entitled to rely on the defence under paragraph (4) unless, within a period ending 7 clear days before the hearing, he has served on the prosecutor a notice in writing giving such information identifying or assisting in the identification of that other person as was then in his possession.
Revocation
10.  The Road Traffic (Carriage of Persons in Goods Vehicles) (Consolidation) Rules (R 1) are revoked.
