Building Control
(Buildable Design) (Amendment)
Regulations 2003
In exercise of the powers conferred by section 49 of the Building Control Act, the Minister for National Development hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Building Control (Buildable Design) (Amendment) Regulations 2003 and shall come into operation on 1st January 2004.
Amendment of regulation 2
2.  Regulation 2 of the Building Control (Buildable Design) Regulations (Rg 8) (referred to in these Regulations as the principal Regulations) is amended —
(a)by deleting the definition of “building plans” and substituting the following definition:
“ “building plans” means the building plans referred to in regulation 4(1)(a)(i) of the Building Control Regulations 2003 (G. N. No. S 666/2003);”; and
(b)by deleting the definitions of “detailed structural plans” and “gross floor area” and substituting the following definitions:
“ “detailed structural plans” means the detailed structural plans referred to in regulation 4(1)(a)(ii) of the Building Control Regulations 2003;
“gross floor area” has the same meaning as “floor area” in the Planning (Development Charges) Rules (Cap. 232, R 5).”.
Amendment of regulation 3
3.  Regulation 3 of the principal Regulations is amended by deleting paragraphs (1) and (2) and substituting the following paragraphs:
(1)  Subject to paragraphs (2) and (3), these Regulations shall apply to any building works in respect of which an application for planning permission is submitted to the competent authority under the Planning Act (Cap. 232) on or after 1st January 2001 and which involve —
(a)if the application is submitted before 1st January 2004, a gross floor area of 5,000 square metres or more; or
(b)if the application is submitted on or after 1st January 2004, a gross floor area of 2,000 square metres or more.
(2)  These Regulations shall not apply to building works consisting of repairs, alterations or additions to an existing building unless the building works involve increasing the gross floor area of the existing building —
(a)in the case of building works for which an application for planning permission is submitted on or after 1st January 2001 but before 1st January 2004, by 5,000 square metres or more; or
(b)in the case of building works for which an application for planning permission is submitted on or after 1st January 2004, by 2,000 square metres or more.”.
Miscellaneous amendments
4.  The principal Regulations are amended by deleting the words “section 6(3)” in regulations 4, 5(2)(a), 6(2)(a) and 8(2)(a) and substituting in each case the words “section 6(3)(a)”.
