(Specified Forklifts — Exemption)
Order 2020
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and period in force
1.—(1)  This Order is the Active Mobility (Specified Forklifts — Exemption) Order 2020.
(2)  This Order is in force for the period starting at 11 p.m. on 7 August 2020 and ending at 6 a.m. on 8 August 2020.
Definitions
2.  In this Order —
“Jalan Besar Town Council” means the Town Council for the Town of Jalan Besar;
“specified activity” means the carrying out of replacement and maintenance works on 2 escalators at Block 32 New Market Road;
“specified footpath” means the part of the footpath delineated by the black‑coloured line in the map set out in the Schedule;
“specified vehicle” means a forklift bearing any of the following vehicle identification numbers:
(a)62‑8FD25;
(b)62‑8FD30;
(c)8FD40N.
Exemption for driver of specified vehicle
3.  Section 16(1)(b) of the Act does not apply to an individual driving a specified vehicle on the specified footpath under the following conditions:
(a)the individual is authorised by the Jalan Besar Town Council to drive the specified vehicle;
(b)the individual has completed and passed a forklift operation course conducted by a forklift training provider that is accredited by the SkillsFuture Singapore Agency to provide the course;
(c)the specified vehicle is driven only in connection with the specified activity;
(d)the individual possesses a valid Class 3, 3A, 3C or 3CA driving licence granted under the Road Traffic (Motor Vehicles, Driving Licences) Rules (Cap. 276, R 27);
(e)the specified vehicle is not driven at a speed exceeding 5 km/h;
(f)there is in force, at any time the specified vehicle is used in connection with the specified activity, a policy of insurance in relation to the specified vehicle insuring against any liability in respect of the death of or bodily injury sustained by any person (other than the driver), or property damage suffered by that person, caused by or arising out of the use of the specified vehicle;
(g)the risk under the policy of insurance mentioned in sub‑paragraph (f) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
