Public Utilities
(Reservoirs and Catchment Areas)
(Amendment) Regulations 2015
In exercise of the powers conferred by section 72 of the Public Utilities Act, the Public Utilities Board, with the approval of the Minister for the Environment and Water Resources, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Public Utilities (Reservoirs and Catchment Areas) (Amendment) Regulations 2015 and shall come into operation on 13 February 2015.
Amendment of regulation 1
2.  Regulation 1 of the Public Utilities (Reservoirs and Catchment Areas) Regulations 2006 (G.N. No. S 401/2006) (referred to in these Regulations as the principal Regulations) is amended by deleting the words “and Catchment Areas” and substituting the words “, Catchment Areas and Waterway”.
Deletion and substitution of heading to Part II
3.  Part II of the principal Regulations is amended by deleting the Part heading and substituting the following Part heading:
ACTIVITIES IN CATCHMENT AREA PARK, CENTRAL WATER CATCHMENT AREA AND WATERWAY”.
Amendment of regulation 6
4.  Regulation 6 of the principal Regulations is amended —
(a)by deleting paragraphs (f), (k) and (l); and
(b)by deleting paragraph (m) and substituting the following paragraph:
(m)consume any beverage containing any alcohol in any part of the Catchment Area Park;”.
New regulation 6A
5.  The principal Regulations are amended by inserting, immediately after regulation 6, the following regulation:
Prohibited activities in waterway
6A.  No person shall pollute any waterway by any means, including by —
(a)bathing or washing himself or any other person, animal or thing in the waterway; or
(b)spitting, urinating or defecating in the waterway.”.
Amendment of regulation 7
6.  Regulation 7 of the principal Regulations is amended —
(a)by deleting the word “or” at the end of paragraph (i);
(b)by deleting the word “marine” in paragraph (j) and substituting the word “aquatic”;
(c)by deleting the full-stop at the end of paragraph (j) and substituting the word “; or”, and by inserting immediately thereafter the following paragraph:
(k)release any animal into any reservoir or any part of the Central Water Catchment Area or Catchment Area Park.”; and
(d)by deleting the regulation heading and substituting the following regulation heading:
Activities in Central Water Catchment Area and Catchment Area Park requiring prior approval”.
New regulation 7A
7.  The principal Regulations are amended by inserting, immediately after regulation 7, the following regulation:
Activities in waterway requiring prior approval
7A.—(1)  No person shall, without the prior approval in writing of an authorised officer —
(a)enter in any waterway;
(b)draw water from any waterway;
(c)release any animal in any waterway; or
(d)fish in any waterway.
(2)  Despite paragraph (1) —
(a)any person may enter in any part of the waterway (commonly known as Kallang River) that is described in the Third Schedule when the audio and visual warning system installed there is not activated to prohibit entry; and
(b)any person may fish in any part of a waterway which is clearly marked out as a designated area for fishing activities by signs erected by or under the authority of the Board.”.
Deletion and substitution of regulation 41
8.  Regulation 41 of the principal Regulations is deleted and the following regulation substituted therefor:
Offences
41.—(1)  Any person who contravenes regulation 4, 5, 6 (other than paragraph (h)), 6A, 7, 7A(1), 10, 11, 15(1), 17(1), 18, 19(1), 20, 21, 23 or 24(1) or any order, requisition or direction made or given under regulation 9, 12, 22(1) or 40 shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $3,000.
(2)  Any person who contravenes regulation 6(h) shall be guilty of an offence and shall be liable on conviction to —
(a)for a first offence, a fine not exceeding $2,000;
(b)for a second offence, a fine not exceeding $4,000; and
(c)for a third or subsequent offence, a fine not exceeding $10,000.”.
New Third Schedule
9.  The principal Regulations are amended by inserting, immediately after the Second Schedule, the following Schedule:
