Charities (Exemption from section 39A)
(Amendment) Regulations 2013
In exercise of the powers conferred by section 48 of the Charities Act, Mr Lawrence Wong, Senior Minister of State, charged with the responsibility of the Minister for Culture, Community and Youth, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Charities (Exemption from section 39A) (Amendment) Regulations 2013 and shall come into operation on 20th November 2013.
Amendment of regulation 2
2.  Regulation 2 of the Charities (Exemption from section 39A) Regulations 2011 (G.N. No. S 487/2011) is amended —
(a)by deleting the word “and” at the end of paragraph (1)(a);
(b)by deleting the full‑stop at the end of sub‑paragraph (b) of paragraph (1) and substituting the word “; and”, and by inserting immediately thereafter the following sub‑paragraph:
(c)any exempt charity or charity registered under the Act, or any organisation (whether or not a charity), which conducts or participates in any fund-raising appeal —
(i)that is for a foreign charitable purpose within the meaning of the Charities (Fund-raising Appeals for Local and Foreign Charitable Purposes) Regulations 2012 (G.N. No. S 530/2012); and
(ii)that appeals to members of the public to give only goods or services or both, but not cash.”; and
(c)by inserting, immediately after paragraph (2), the following paragraph:
(3)  In paragraph (1)(c), “organisation” means —
(a)any company that is incorporated or registered under the Companies Act (Cap. 50); or
(b)any society that is registered under the Societies Act (Cap. 311).”.
