Sale of Food Act
(CHAPTER 283)
Food (Amendment No. 3) Regulations 2020
In exercise of the powers conferred by section 56(1) of the Sale of Food Act, the Minister for Sustainability and the Environment makes the following Regulations:
Citation and commencement
1.  These Regulations are the Food (Amendment No. 3) Regulations 2020 and come into operation on 31 August 2020.
Amendment of regulation 18
2.  Regulation 18 of the Food Regulations (Rg 1) is amended by deleting paragraph (1) and substituting the following paragraph:
(1)  In these Regulations —
“steviol glycosides” means any of the following:
(a)steviol glycosides from Stevia rebaudiana Bertoni;
(b)Rebaudioside A from multiple gene donors expressed in Yarrowia lipolytica;
(c)Rebaudioside M produced by enzymatic modification of Rebaudioside A extracted from Stevia leaf, using the enzymes UDP‑glucosyltransferase (EC 2.4.1.17) and sucrose synthase (EC 2.4.1.13), produced by genetically modified strains of Escherichia coli K‑12 W311;
(d)Rebaudioside M produced by enzymatic conversion of purified Stevia leaf extract, using the enzymes UDP-glucosyltransferase (EC 2.4.1.17) and sucrose synthase (EC 2.4.1.13), produced by genetically modified strains of Pichia pastoris;
“sweetening agent” means a substance added to food in place of sugar to provide a sweet taste, but does not include aspartame, any sugar, carbohydrate or polyhydric alcohols.”.
Amendment of regulation 28
3.  Regulation 28 of the Food Regulations is amended —
(a)by inserting, immediately after the words “Eighth Schedule” in paragraph (2), the words “or permitted for use under this regulation”; and
(b)by inserting, immediately after paragraph (6), the following paragraph:
(7)  Soy leghemoglobin derived from genetically modified Pichia pastoris may be used in meat analogues, at a level not exceeding 0.45% (w/w).”.
Deletion and substitution of regulation 116
4.  Regulation 116 of the Food Regulations is deleted and the following regulation substituted therefor:
Butter
116.—(1)  Butter is a fatty product that is derived exclusively from milk, products obtained from milk, or both, and is principally in the form of an emulsion of the type water-in-oil.
(2)  Butter must contain —
(a)not less than 80% (w/w) milk fat;
(b)not more than 16% (w/w) water; and
(c)not more than 2% non-fat milk solids.
(3)  Butter may not contain any added substance except —
(a)harmless vegetable colouring matter;
(b)salt;
(c)starter cultures of harmless lactic acid producing bacteria, flavour producing bacteria, or both;
(d)water; or
(e)any substance expressly permitted in butter under these Regulations.”.
Amendment of regulation 204
5.  Regulation 204 of the Food Regulations is amended by deleting paragraph (2).
Amendment of Third Schedule
6.  The Third Schedule to the Food Regulations is amended —
(a)by deleting the words “(estimated by weight)” in the heading of column 3 of the table in paragraph 1;
(b)by deleting the entries under columns 2 and 3 corresponding to item (a) of the table in paragraph 1 and substituting the following entries in the appropriate columns as shown:

Amendment of Part I of Fourth Schedule

Amendment of Part II of Fifth Schedule
8.  Paragraph 2 of Part II of the Fifth Schedule to the Food Regulations is amended by inserting, immediately after the word “lutein,” in sub‑paragraph (b), the words “lutein esters from Tagetes erecta,”.
Amendment of Part II of Seventh Schedule
9.  Item 2 of Part II of the Seventh Schedule to the Food Regulations is amended by inserting, immediately below the entry “Ferrous ammonium phosphate”, the entry “Ferrous bisglycinate”.
Amendment of Eighth Schedule
10.  The Eighth Schedule to the Food Regulations is amended —
(a)by deleting the item “Hydrogenated glucose syrup (maltitol and maltitol-based products);” in Part 1;
(b)by inserting, immediately below the item “Malic acid;” in Part 1, the following items:
Maltitol;
Maltitol syrup (hydrogenated glucose syrup);”;
(c)by inserting, immediately below the item “Sorbitol;” in Part 1, the following item:
Sorbitol syrup;”; and
