(Prohibition of Sale and Supply)
(Amendment) Order 2012
In exercise of the powers conferred by section 30 of the Medicines Act, the Minister for Health hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Medicines (Prohibition of Sale and Supply) (Amendment) Order 2012 and shall come into operation on 1st January 2013.
Amendment of paragraph 3
2.  Paragraph 3(1) of the Medicines (Prohibition of Sale and Supply) Order (O 4) (referred to in this Order as the principal Order) is amended by deleting the words “the Schedule” in sub‑paragraph (c) and substituting the words “the First Schedule”.
New paragraph 5
3.  The principal Order is amended by inserting, immediately after paragraph 4, the following paragraph:
Prohibition on importation, sale and supply of Chinese proprietary medicine containing poisons
5.  No person shall import, or sell or supply to any person, any Chinese proprietary medicine which contains any item specified in the Poisons List in the Schedule to the Poisons Act (Cap. 234), unless that item —
(a)is a substance specified in the first column of the Second Schedule and satisfies the limit or condition in the second column of that Schedule; and
(b)is present naturally in the ingredients of the Chinese proprietary medicine.”.
Renaming of Schedule and new Second Schedule
4.  The principal Order is amended —
(a)by renaming the existing Schedule as the First Schedule; and
(b)by inserting, immediately after the First Schedule, the following Schedule:
