Misuse of Drugs
(Urine Specimens and Urine Tests)
(Amendment) Regulations 2020
In exercise of the powers conferred by section 58 of the Misuse of Drugs Act, the Minister for Home Affairs makes the following Regulations:
Citation and commencement
1.  These Regulations are the Misuse of Drugs (Urine Specimens and Urine Tests) (Amendment) Regulations 2020 and come into operation on 31 August 2020.
Amendment of regulation 2
2.  Regulation 2 of the Misuse of Drugs (Urine Specimens and Urine Tests) Regulations (Rg 6) (called in these Regulations the principal Regulations) is amended by inserting, immediately after the word “sergeant” in the definition of “enforcement officer”, the words “, a serviceman in the Singapore Armed Forces who is appointed by the Minister as an enforcement officer under section 31(1B) of the Act”.
Deletion and substitution of regulations 3, 4 and 5
3.  Regulations 3, 4 and 5 of the principal Regulations are deleted and the following regulations substituted therefor:
Taking and depositing of urine specimens
3.—(1)  Every suspect who is required to give a urine specimen for urine tests under section 31 of the Act or regulation 15(3)(f) of the Misuse of Drugs (Approved Institutions, Medical Observation and Treatment and Rehabilitation) Regulations (Rg 3), and every enforcement officer or other officer authorised by the enforcement officer taking the urine specimen, must do so in accordance with the First Schedule.
(2)  Only a person authorised by the Permanent Secretary to the Ministry of Home Affairs or the Chief Executive of the Health Sciences Authority may have possession of the key to any security box.
Collection and delivery of security boxes
4.  Every person involved in the collection and delivery of urine specimens deposited in security boxes must do so in accordance with the Second Schedule.
Urine test
5.  The Chief Executive of the Health Sciences Authority must arrange for each of the 2 urine specimens to be tested by a different officer and the results of the 2 urine tests must be sent to the enforcement officer in charge of the case.”.
Amendment of First Schedule
4.  The First Schedule to the principal Regulations is amended —
(a)by inserting, immediately after the words “each of” in paragraphs 5(1) and 11(1), the word “the”; and
(b)by inserting, immediately after the word “wash” in paragraph 6(3), the words “and dry”.
Deletion and substitution of Second Schedule
5.  The Second Schedule to the principal Regulations is deleted and the following Schedule substituted therefor:

collection and delivery of urine specimens and
security arrangements for collection and delivery
1.  An enforcement officer must arrange for the delivery of the 2 security boxes as soon as practicable to the Health Sciences Authority.
2.  After the 2 security boxes have been delivered to the Health Sciences Authority, the officer who has custody of the key must unlock the 2 boxes and empty their contents in the presence of the officer who delivered the boxes.
3.  The empty security boxes must be re-locked and handed back to the officer who delivered the boxes.”.
