Patents (Amendment) Rules 2010

In exercise of the powers conferred by section 115 of the Patents Act, the Minister for Law, after consulting with the Intellectual Property Office of Singapore, hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Patents (Amendment) Rules 2010 and shall come into operation on 6th December 2010.

Amendment of rule 2

2. Rule 2(3) of the Patents Rules (R 1) is amended by deleting the words “the Australian Patent Office,”.

Amendment of First Schedule

3. Item 56B in the First Schedule to the Patents Rules is amended by deleting paragraph (a).

Savings and transitional provision

4. Rule 2 shall not apply to —

(a)	any request for a search report, an examination report or a search and examination report filed under section 29 of the Act and forwarded to the Australian Patent Office before 6th December 2010; and
(b)	any request for a search and examination report filed under section 38A(1) of the Act and forwarded to the Australian Patent Office before 6th December 2010,

and rule 2(3) of the Patents Rules in force immediately before that date shall continue to apply to any such request as if rule 2 had not been made.
