(Amendment) Act 2016 (Saving and Transitional
Provisions) Regulations 2017
In exercise of the powers conferred by section 32(3) of the Tobacco (Control of Advertisements and Sale) (Amendment) Act 2016, the Minister for Health makes the following Regulations:
Citation and commencement
1.  These Regulations are the Tobacco (Control of Advertisements and Sale) (Amendment) Act 2016 (Saving and Transitional Provisions) Regulations 2017 and come into operation on 30 December 2017.
Definitions
2.  In these Regulations —
“amended Act” means the Tobacco (Control of Advertisements and Sale) Act (Cap. 309) as in force on 30 December 2017;
“amendment Act” means the Tobacco (Control of Advertisements and Sale) (Amendment) Act 2016 (Act 9 of 2016);
“Licensing Regulations” means the Tobacco (Control of Advertisements and Sale) (Licensing) Regulations 2017 (G.N. No. S 763/2017);
“revoked Regulations” means the Tobacco (Control of Advertisements and Sale) (Licensing of Importers, Wholesalers and Retailers) Regulations 2010 (G.N. No. S 478/2010) as in force immediately before 30 December 2017;
“unamended Act” means the Tobacco (Control of Advertisements and Sale) Act as in force immediately before 30 December 2017.
Licences granted before 30 December 2017
3.  From 30 December 2017, any licence granted or renewed under the revoked Regulations that is valid immediately before that date —
(a)is deemed to be a licence granted under section 18(8) of the amended Act, and expires on the date it would have expired if the amendment Act had not been enacted, unless earlier revoked or cancelled by the Authority under the Licensing Regulations;
(b)is subject to the terms and conditions set out in the licence as if the terms and conditions have been specified under section 18(8) of the amended Act; and
(c)may be renewed, revoked, suspended or otherwise dealt with in accordance with the amended Act and the Licensing Regulations.
Pending applications
4.  An application for a grant or renewal of a licence under the revoked Regulations and that is pending before 30 December 2017 is deemed to be an application made under section 18(7) of the amended Act.
Appeals to Minister
5.  An appeal to the Minister made under section 18(3) of the unamended Act, and that is pending on 30 December 2017, is deemed to be an appeal made under section 18(10) of the amended Act.
