(Amendment) Order 2023
In exercise of the powers conferred by section 82 of the Infrastructure Protection Act 2017, the Minister for Home Affairs makes the following Order:
Citation and commencement
1.  This Order is the Infrastructure Protection (Protected Areas and Protected Places) (Photography) (Exemption) (Amendment) Order 2023 and comes into operation on 20 February 2023.
Amendment of paragraph 3
2.  In paragraph 3 of the Infrastructure Protection (Protected Areas and Protected Places) (Photography) (Exemption) Order 2018 (G.N. No. S 818/2018), in the paragraph heading, after “Exemption”, insert “for authorised trials and unmanned aircrafts”.
New paragraph 4
3.  In the Infrastructure Protection (Protected Areas and Protected Places) (Photography) (Exemption) Order 2018, after paragraph 3, insert —
Exemption for specified officers
4.—(1)  Section 29(1) of the Act does not apply to or in relation to a specified officer who takes a photograph of a protected area or a protected place if —
(a)the specified officer takes the photograph to perform or discharge the specified officer’s duty; and
(b)where the photograph is taken using a device or equipment — that device or equipment is registered with, or issued by, a Home Team agency or the HTX.
(2)  In this paragraph —
“Home Team agency” means any department of the Government within the Ministry of Home Affairs;
“HTX” means the Home Team Science and Technology Agency established by section 3 of the Home Team Science and Technology Agency Act 2019;
“specified officer” means —
(a)an officer of the Central Narcotics Bureau appointed under section 3 of the Misuse of Drugs Act 1973;
(b)an immigration officer of the Immigration & Checkpoints Authority appointed under section 3 of the Immigration Act 1959;
(c)an officer or employee of, or a person seconded to, the HTX;
(d)a police officer, a special police officer, a forensic specialist or an intelligence officer, within the meaning given by the Police Force Act 2004;
(e)an officer of the Singapore Civil Defence Force raised and maintained in accordance with the Civil Defence Act 1986; or
(f)a prison officer of the Singapore Prison Service who is appointed under section 20 of the Prisons Act 1933.”.
