Prevention of Pollution of the Sea
(Garbage) (Amendment)
Regulations 2020
In exercise of the powers conferred by section 34 of the Prevention of Pollution of the Sea Act, the Maritime and Port Authority of Singapore, with the approval of the Minister for Transport, makes the following Regulations:
Citation and commencement
1.  These Regulations are the Prevention of Pollution of the Sea (Garbage) (Amendment) Regulations 2020 and come into operation on 1 October 2020.
Amendment of regulation 5
2.  Regulation 5 of the Prevention of Pollution of the Sea (Garbage) Regulations 2012 (G.N. No. S 663/2012) is amended by deleting paragraph (1) and substituting the following paragraphs:
(1)  Except as provided in paragraph (1A), references to the Administration are to be read as references to the Director.
(1A)  For the purposes of regulations 1.19 and 10.3 of Annex V, references to the Administration are to be read as references to the Director or an authorised organisation.”.
Amendment of First Schedule
3.  The First Schedule to the Prevention of Pollution of the Sea (Garbage) Regulations 2012 is amended —
(a)by inserting, immediately after paragraph 18 of regulation 1, the following paragraph:
 
“19.  Electronic Record Book means a device or system, approved by the Administration, used to electronically record the required entries for discharges, transfers and other operations as required under this Annex in lieu of a hard copy record book.”;
(b)by deleting paragraph 3 of regulation 10 and substituting the following paragraph:
 
“3.  Every ship of 400 gross tonnage and above and every ship which is certified to carry 15 or more persons engaged in voyages to ports or offshore terminals under the jurisdiction of another Party to the Convention and every fixed or floating platform shall be provided with a Garbage Record Book. The Garbage Record Book, whether as a part of the ship’s official logbook, or as an electronic record book which shall be approved by the Administration taking into account the Guidelines developed by the Organization*, or otherwise, shall be in the form specified in Appendix II to this Annex:
 
 * Refer to the Guidelines for the use of electronic record books under MARPOL, adopted by resolution MEPC.312(74).”; and
(c)by inserting, immediately after the words “completed page” in paragraph 3.1 of regulation 10, the words “or group of electronic entries”.
