(Amendment No. 2) Order 2023
In exercise of the powers conferred by section 53 of the Healthcare Services Act 2020, the Minister for Health makes the following Order:
Citation and commencement
1.  This Order is the Healthcare Services (Exemption) (Amendment No. 2) Order 2023 and comes into operation on 18 December 2023.
Amendment of paragraph 2
2.  In the Healthcare Services (Exemption) Order 2021 (G.N. No. S 1042/2021) (called in this Order the principal Order), in paragraph 2 —
(a)in the definition of “business name”, replace the full‑stop at the end with a semi‑colon; and
(b)after the definition of “business name”, insert —
“ “registered nurse” means a person who is a registered nurse within the meaning of the Nurses and Midwives Act 1999 and holds a valid practising certificate under that Act.”.
Amendment of paragraph 3
3.  In the principal Order, in paragraph 3 —
(a)in sub‑paragraphs (1)(b), (3)(b) and (5)(b), replace “Private Hospitals and Medical Clinics Act 1980” with “repealed Act”;
(b)in sub‑paragraph (5), replace “a licensee (C)” with “a person (C) who holds a licence to provide a cord blood banking service”; and
(c)after sub‑paragraph (5), insert —
(5A)  Section 24(2) of the Act and regulation 7(1)(b) of the Healthcare Services (Nursing Home Service) Regulations 2023 (G.N. No. S 849/2023) do not apply to a person (D) who holds a licence to provide a nursing home service in respect of D’s appointment of an individual as a Clinical Governance Officer, if all of the following are satisfied:
(a)D had, immediately before 18 December 2023, held a valid licence under the repealed Act in relation to the use of any premises as a nursing home;
(b)the premises mentioned in sub‑paragraph (a) are, from and including that date, D’s approved permanent premises for the provision of the nursing home service;
(c)the individual is a registered nurse who —
(i)is not subject to any condition imposed on his or her registration by the Singapore Nursing Board under section 17(2) of the Nurses and Midwives Act 1999; and
(ii)immediately before 18 December 2023, had performed all the functions of a Clinical Governance Officer in respect of the nursing home at the premises mentioned in sub‑paragraph (a).”.
Amendment of paragraph 4
4.  In the principal Order, in paragraph 4 —
(a)in the paragraph heading, replace “Private Hospitals and Medical Clinics Act 1980” with “repealed Act”; and
(b)in sub‑paragraph (2), replace “Private Hospitals and Medical Clinics Act 1980” with “repealed Act”.
Deletion of paragraph 11
5.  In the principal Order, delete paragraph 11.
New paragraphs 22, 23 and 24
6.  In the principal Order, after paragraph 21, insert —
Exemption in relation to provision of contingency care service by nursing home service licensee
22.  Section 8 of the Act does not apply in relation to the provision of a contingency care service by a person who holds a valid licence to provide a nursing home service and treats, as part of the provision of the nursing home service, an inpatient for an infectious disease specified in the First Schedule to the Infectious Diseases Act 1976.
Exemption relating to head of nursing for nursing home service
23.  Regulation 8(1) of the Healthcare Services (Nursing Home Service) Regulations 2023 does not apply to a person (X) who holds a licence to provide a nursing home service in respect of X’s appointment of an individual as the head of nursing for any approved permanent premises of X during the period from 18 December 2023 to 17 December 2028 (both dates inclusive), if all of the following are satisfied:
(a)X had, immediately before 18 December 2023, held a valid licence under the repealed Act in relation to the use of any premises as a nursing home;
(b)the premises mentioned in sub‑paragraph (a) are, from and including that date, X’s approved permanent premises for the provision of the nursing home service;
(c)the individual is a registered nurse who had, immediately before that date, performed all the functions mentioned in regulation 8(2)(a) to (e) of the Healthcare Services (Nursing Home Service) Regulations 2023 in respect of the nursing home at the premises mentioned in sub‑paragraph (a).
Exemption in relation to provision of nursing home service by specified persons
24.  Section 8 of the Act does not apply in relation to the provision of a nursing home service by any of the following persons:
(a)a person who holds a valid licence under the Children and Young Persons Act 1993, where that service is provided at the premises of the home for children and young persons to which that licence relates;
(b)a person who holds a valid licence under the Homes for the Aged Act 1988, where that service is provided at the premises of the home for the aged to which that licence relates;
(c)a person who operates a home or hostel specified in the Third Schedule, where that service is provided at the premises of the home or hostel.”.
