(Amendment) Regulations 2022

In exercise of the powers conferred by section 62 of the Air Navigation Act 1966, the Minister for Transport makes the following Regulations:

Citation and commencement

1. These Regulations are the Air Navigation (Licensing of Air Services) (Amendment) Regulations 2022 and come into operation on 1 December 2022.

Amendment of regulation 2J

2. In regulation 2J(1A) of the Air Navigation (Licensing of Air Services) Regulations (Rg 2), replace sub‑paragraphs (a), (b) and (c) with —

“(a)

where the licensee holds only a Category A licence —

(i)

if the air services are provided or to be provided any time between 1 April 2022 and 31 March 2023 (both dates inclusive), the sum of —

(A)	$1,617.75 for air services provided between 1 April 2022 and 30 November 2022 (both dates inclusive); and
(B)	$895.07 for air services to be provided between 1 December 2022 and 31 March 2023 (both dates inclusive); or

(ii)

if the air services are to be provided on or after 1 April 2023 — $2,700;

(b)

where the licensee holds both a Category A licence and a Category B licence —

(i)

if the air services are provided or to be provided any time between 1 April 2022 and 31 March 2023 (both dates inclusive), the sum of —

(A)	$1,617.75 for air services provided between 1 April 2022 and 30 November 2022 (both dates inclusive); and
(B)	$895.07 for air services to be provided between 1 December 2022 and 31 March 2023 (both dates inclusive); or

(ii)

if the air services are to be provided on or after 1 April 2023 — $2,700;

(c)

where the licensee holds only a Category B licence —

(i)

if the air services are provided or to be provided any time between 1 April 2022 and 31 March 2023 (both dates inclusive), the sum of —

(A)	$1,604.38 for air services provided between 1 April 2022 and 30 November 2022 (both dates inclusive); and
(B)	$762.47 for air services to be provided between 1 December 2022 and 31 March 2023 (both dates inclusive); or

(ii)

if the air services are to be provided on or after 1 April 2023 — $2,300.”.
