Muslim Marriage and Divorce (Amendment) Rules 1997

In exercise of the powers conferred by section 145 of the Administration of Muslim Law Act, the President of Singapore hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Muslim Marriage and Divorce (Amendment) Rules 1997 and shall come into operation on 1st April 1997.

Amendment of rule 32

2. Rule 32 of the Muslim Marriage and Divorce Rules (R 1) (referred to in these Rules as the principal Rules) is amended —

(a)

by deleting paragraph (1) and substituting the following paragraph:

“(1) The following fees shall be payable to the Kadis or Naib Kadis:

(a)	for registering a marriage (inclusive of the issue of 2 copies of a certificate of marriage)

(b)	for registering a divorce (inclusive of the issue of 2 copies of a certificate of divorce)

(c)	for registering a revocation of divorce (inclusive of the issue of 2 copies of a certificate of revocation of divorce)

(d)	for the issue of a certified copy of the grounds for the refusal to register a marriage, divorce or revocation of divorce under section 104(3) of the Act

(e)	for the issue of a summons under section 142 of the Act

(f)	for a certified copy of the notes of evidence of any proceedings before a Kadi or Naib Kadi (per page)

”; and

(b)

by deleting “$15” in the fifth line of paragraph (3) and substituting “$18”.

Amendment of rule 33

3. Rule 33 of the principal Rules is amended by deleting “$14” in paragraph (1)(a) and substituting “$15”.

Deletion and substitution of rule 34

4. Rule 34 of the principal Rules is deleted and the following rule substituted therefor:

“Court fees

34. The following fees shall be payable to the Court:

(a)	on sealing of a summons for the commencement of proceedings for —

(i)	maintenance

(ii)	emas kahwin (marriage payment)

(iii)

mutaah (compensation)

(iv)

divorce

(b)	for any application not made at a hearing

(c)	for registering a divorce of talak, fasakh, taklik or khuluk

(d)	for the issue of a certified copy of an order or decree

(e)	for the issue of a summons to witness

(f)	for the service of a summons on a defendant or witness (in addition to the cost of transport incurred by the process server, which is to be provided or paid in cash by the person requesting the service if the place at which the service is to be effected is beyond 2 kilometers from the Court House)

(g)	for a certified copy of notes of evidence of any proceedings before the Court (per page)

(h)	for a certified copy of the grounds of any judgment

(i)	on filing a notice of appeal

(j)	for the hearing of an appeal by the Appeal Board

(k)	for the issue of a certificate of inheritance (per page)

(l)	for the issue of a revised certificate of inheritance on the death of one or more of the beneficiaries of the estate before the final distribution of the estate is made (per page)
