Termination of Pregnancy
(Amendment) Regulations 2024

In exercise of the powers conferred by section 11 of the Termination of Pregnancy Act 1974, the Minister for Health makes the following Regulations:

Citation and commencement

1. These Regulations are the Termination of Pregnancy (Amendment) Regulations 2024 and come into operation on 1 March 2024.

Amendment of regulation 2

2. In the Termination of Pregnancy Regulations (Rg 1) (called in these Regulations the principal Regulations), in regulation 2 —

(a)	in paragraph (1), delete “to the Minister”;
(b)	in paragraph (4), replace “The Minister may reject an application made under paragraph (1)” with “An application made under paragraph (1) may be rejected”; and
(c)	in paragraph (5), replace “The Minister may cancel the approval granted to any institution under paragraph (1)” with “The approval granted to any institution under paragraph (1) may be cancelled”.

Amendment of regulation 3

3. In the principal Regulations, in regulation 3, replace “Minister” wherever it appears with “Director‑General of Health”.

Amendment of regulation 5

4. In the principal Regulations, in regulation 5(1) and (5), replace “Minister” with “Director‑General of Health”.

Replacement of regulation 11

5. In the principal Regulations, replace regulation 11 with —

“Cancellation of approval or authorisation of approved institution

11. Without limiting regulation 2(5), the approval for the use of any place as an approved institution and the authorisation to carry out treatment to terminate pregnancy may be cancelled if any authorised medical practitioner contravenes or fails to comply with any of the provisions of regulation 4, 5, 6, 8, 9 or 10 and any condition specified under regulation 3(3).”.

Amendment of regulation 12

6. In the principal Regulations, in regulation 12(1)(c), delete “by the Minister”.
