GENERAL

Citation

1. These Regulations may be cited as the Merchant Shipping (Proficiency in Survival Craft) Regulations.

Definitions

2. In these Regulations, unless the context otherwise requires —

“Certificate of Proficiency in Survival Craft” means a Certificate of Proficiency in Survival Craft issued by the Director under these Regulations;

“survival craft” includes an approved lifeboat, liferaft or any other craft used for survival at sea.

Application for examination

3.—(1) An application for an examination for a Certificate of Proficiency in Survival Craft shall be made in such form as may be approved by the Director.

(2) The application may be made on behalf of the candidate by an owner, master or an agent of a ship, or in the case of an approved nautical school, by a person in charge of that school.

(3) An application shall not be made for the examination for less than 10 persons at any one time, unless arrangements have been made to make up for the required 10 persons by persons not taking the examination.

(4) The prescribed fees for the examination shall be paid at the time of application. The minimum fee payable shall be for 10 persons.

Place and date of examination

4. The place and date of each examination shall be fixed by the Director.

Requirements for issue of certificates

5.—(1) Every candidate applying for a Certificate of Proficiency in Survival Craft shall —

(a)	be not less than 18 years of age;
(b)	have approved sea service of not less than 12 months or have attended an approved training course and have approved sea service of not less than 9 months; and
(c)	be free from any physical or other disability which will render him incapable of performing the duties required of him in a survival craft.

(2) Any person who cannot satisfy the requirements of paragraph (1)(b) may, with the consent of the Director, be allowed to sit for the examination. If such a person passes the examination, he shall not be issued with a certificate until he has satisfied the requirements of that sub-paragraph.

(3) The syllabus for the examination is specified in the Schedule.

Issue of certificates and equivalents

6.—(1) A Certificate of Proficiency in Survival Craft shall be issued to a candidate who satisfies the requirements of regulation 5.

(2) A valid Certificate of Efficiency as Lifeboatman granted by the Director under the Act before 1st August 1986 shall be treated as equivalent to a Certificate of Proficiency in Survival Craft.

(3) A certificate issued by or under the authority of any other government for proficiency in survival craft may at the discretion of the Director be accepted as equivalent to a certificate issued under these Regulations.

Cancellation of certificates

7. If the Director has reason to believe that the holder of a Certificate of Proficiency in Survival Craft no longer possesses the necessary qualifications, he may require him to be re-examined; and if the result of the re-examination is not satisfactory his certificate may be cancelled.

Protection to examiners

8. An examiner shall not be liable for any suit, claim or demand by reason of anything done or refused in good faith pursuant to these Regulations.
