(Activities to Support Tourism — Exemption)
Order 2021
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and period in force
1.—(1)  This Order is the Active Mobility (Activities to Support Tourism — Exemption) Order 2021.
(2)  This Order is in force for the period between 20 January 2021 and 19 January 2023 (both dates inclusive).
Definitions
2.  In this Order —
“specified footpath” means a footpath that is delineated by a black‑coloured line in the map set out in the Schedule;
“STB” means the Singapore Tourism Board established by section 3 of the Singapore Tourism Board Act (Cap. 305B);
“tourism event” means any event or series of related activities taking place in Singapore —
(a)that promote Singapore as a travel or tourist destination; or
(b)that is intended wholly or partly for the benefit of, or for the purpose of attracting, visitors to Singapore.
Exemption for driving relevant motor vehicle in connection with tourism event
3.—(1)  Section 16(1)(b) of the Act does not apply to an individual who drives a relevant motor vehicle on a specified footpath under the following conditions:
(a)the individual is authorised by the STB to drive the relevant motor vehicle for any of the following purposes:
(i)to transport any individual or thing in connection with a tourism event;
(ii)for any maintenance works in connection with a tourism event;
(b)the relevant motor vehicle is driven only for a purpose mentioned in sub‑paragraph (a);
(c)the individual who drives the relevant motor vehicle must give way to other users of the specified footpath;
(d)the individual possesses a valid driving licence granted under the Road Traffic (Motor Vehicles, Driving Licences) Rules (Cap. 276, R 27) authorising the individual to drive the class of the relevant motor vehicle;
(e)there is in force, at any time the relevant motor vehicle is used in connection with the tourism event, a policy of insurance in relation to the relevant motor vehicle insuring against any liability in respect of the death of or bodily injury sustained by any person (other than the driver or any passenger of the relevant motor vehicle), or property damage suffered by any person (other than the driver or any passenger of the relevant motor vehicle), caused by or arising out of the use of the relevant motor vehicle;
(f)the risk under the policy of insurance mentioned in sub‑paragraph (e) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
(2)  In this paragraph, “relevant motor vehicle” means any motor vehicle other than the following motor vehicles:
(a)a motorised personal mobility device;
(b)a power‑assisted bicycle;
(c)a motorised wheelchair;
(d)a mobility scooter;
(e)an automatic detection device that has wheels and a motor and is constructed to drive itself;
(f)a robotic machine designed to move and operate independently of human control when the computer that controls it is programmed;
(g)a motor vehicle that is constructed to drive itself;
(h)a forklift;
(i)a boom lift.
Exemption for driving forklift and boom lift
4.  Section 16(1)(b) of the Act does not apply to an individual who drives a forklift or boom lift on a specified footpath under the following conditions:
(a)in the case of a forklift, the individual —
(i)is authorised by the STB to use the forklift to transport anything in connection with a tourism event; and
(ii)has attended and passed the Singapore Workforce Skills Qualifications (WSQ) — Operate Forklift Course;
(b)in the case of a boom lift, the individual —
(i)is authorised by the STB to use the boom lift for maintenance works in connection with a tourism event; and
(ii)has attended and passed the Singapore Workforce Skills Qualifications (WSQ) — Operate Boom Lift Course;
(c)the forklift or boom lift is only used —
(i)in the case of a forklift — for the purpose referred to in sub‑paragraph (a)(i); or
(ii)in the case of a boom lift — for the purpose referred to in sub‑paragraph (b)(i);
(d)there is in force, at any time the forklift or boom lift is used in connection with the tourism event, a policy of insurance in relation to the forklift or boom lift insuring against any liability in respect of the death of or bodily injury sustained by any person (other than the driver of the forklift or boom lift), or property damage suffered by any person (other than the driver of the forklift or boom lift), caused by or arising out of the use of the forklift or boom lift;
(e)the risk under the policy of insurance mentioned in sub‑paragraph (d) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
Exemption for driving specified motor vehicle in connection with specified tourism event
5.—(1)  Section 16(1)(b) of the Act does not apply to an individual who drives a specified motor vehicle on a specified footpath under the following conditions:
(a)the individual is authorised by the STB to use the specified motor vehicle in connection with a specified tourism event;
(b)the specified motor vehicle is only used in connection with the specified tourism event;
(c)there is in force, at any time the specified motor vehicle is used in connection with the specified tourism event, a policy of insurance in relation to the specified motor vehicle insuring against any liability in respect of the death of or bodily injury sustained by any person (other than the driver or any passenger of the specified motor vehicle), or property damage suffered by any person (other than the driver or any passenger of the specified motor vehicle), caused by or arising out of the use of the specified motor vehicle;
(d)the risk under the policy of insurance mentioned in sub‑paragraph (c) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
(2)  In this paragraph —
“specified motor vehicle” means —
(a)a Go‑kart;
(b)a motor car; or
(c)a motorcycle;
“specified tourism event” means a tourism event that mainly involves any of the following activities:
(a)the competitive or recreational racing of specified motor vehicles;
(b)the filming of one or more specified motor vehicles;
(c)the display of one or more specified motor vehicles.
