(Cycling Without Age E-Trishaw Trial —
Exemption) Order 2019
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and period in force
1.—(1)  This Order is the Active Mobility (Cycling Without Age E‑Trishaw Trial — Exemption) Order 2019.
(2)  This Order is in force for one year starting 20 September 2019.
Definitions
2.  In this Order —
“CWA Singapore” means the company incorporated under the Companies Act (Cap. 50) as Cycling Without Age Singapore Ltd. (UEN 201714757N);
“specified e‑trishaw” means a three‑wheeled pedal cycle that —
(a)is constructed or adapted for the carriage of passengers;
(b)is equipped with an electric motor;
(c)may be propelled by human power or by the electric motor with which it is equipped, or by both; and
(d)is used by CWA Singapore for the purpose of the trial;
“specified route” means a route, comprising one or more footpaths or shared paths, that is specified in the Schedule;
“trial” means the trial to assess the feasibility of the regular use, by CWA Singapore, of e‑trishaws on public paths to carry certain passengers for leisure.
Exemption for driver of specified e‑trishaw
3.—(1)  Sections 16(1)(b) and 17 of the Act do not apply to an individual who drives a specified e‑trishaw on a specified route during the trial times mentioned in sub‑paragraph (2) under the following conditions:
(a)the individual has completed a training course conducted by CWA Singapore on how to drive an e‑trishaw and is authorised by CWA Singapore to drive the specified e‑trishaw;
(b)the specified e‑trishaw is only used to carry, for their leisure, passengers who are elderly, unable to walk or have difficulty in walking;
(c)the specified e‑trishaw is not used to carry passengers for hire or reward;
(d)the individual who drives the specified e-trishaw must —
(i)drive at a speed not exceeding 10 km/h;
(ii)give way to other users of the specified route;
(iii)not carry, at any time, more than 2 passengers; and
(iv)drive with all passengers on the specified e‑trishaw safely secured;
(e)no other specified e‑trishaw is used at the time on the specified route;
(f)the specified e‑trishaw is accompanied by a safety marshal who ensures the safe use of the specified e‑trishaw;
(g)there is in force, at any time the specified e‑trishaw is used in connection with the trial, a policy of insurance in relation to the specified e‑trishaw insuring against any liability in respect of the death of or bodily injury sustained by any person (other than the driver or any passenger), or property damage suffered by that person, caused by or arising out of the use of the specified e‑trishaw.
(2)  The trial times are as follows:
(a)for the specified routes in Parts 1, 2 and 3 of the Schedule — from 9.30 a.m. to 8 p.m.;
(b)for the specified routes in Parts 4, 5, 6, 7 and 8 of the Schedule —
(i)from 9.30 a.m. to 8 p.m. on a Saturday, Sunday or public holiday; and
(ii)from 9.30 a.m. to 1.30 p.m. and 2.30 p.m. to 8 p.m. on a day other than a Saturday, Sunday or public holiday.
