(Gardens by the Bay — Exemption)
Order 2020
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and period in force
1.—(1)  This Order is the Active Mobility (Gardens by the Bay — Exemption) Order 2020.
(2)  This Order is in force for the period between 16 November 2020 and 15 May 2021 (both dates inclusive).
Definitions
2.  In this Order —
“specified motor vehicle” means an autonomous motor vehicle that —
(a)is known as an auto‑rider (model: NAVYA ARMA); and
(b)has complied with the requirements of the test known as the Supervised Trial Readiness Assessment (Provisional Version) for Autonomous Vehicles on Public Paths that is jointly administered by the Centre of Excellence for Testing & Research of Autonomous Vehicles — NTU (CETRAN) and the Authority;
“specified person” means any of the following companies incorporated under the Companies Act (Cap. 50):
(a)Car Club Pte Ltd (UEN 200912077G);
(b)ST Engineering Land Systems Ltd (UEN 197100263N);
(c)Willers Pte Ltd (UEN 201816662N);
“specified shared path” means the part of the shared path specified in item 5 of Part 11 of the First Schedule to the Active Mobility (Shared Paths) Order 2018 (G.N. No. S 260/2018), and which is more particularly delineated by the black line in the map set out in the Schedule.
Exemption for specified motor vehicle drivers
3.  Section 17(1) of the Act does not apply to an individual driving a specified motor vehicle on the specified shared path under the following conditions:
(a)the individual (called in this Order the safety operator) is authorised by a specified person to drive the specified motor vehicle;
(b)the safety operator must remain in the specified motor vehicle at all times when the vehicle is in motion;
(c)the safety operator must only be engaged in the following activities while the specified motor vehicle is travelling in autonomous mode:
(i)monitor the movement of the specified motor vehicle;
(ii)take manual control of the specified motor vehicle when a failure of the autonomous system of the vehicle or other emergency is detected;
(d)the specified motor vehicle is only driven —
(i)for the purpose of transporting people;
(ii)from 10.30 a.m. to 9.30 p.m. daily; and
(iii)at a speed not exceeding 10 km/h;
(e)the specified motor vehicle is lit in a manner that is visible to other specified shared path users from 7 p.m. to 9.30 p.m.;
(f)no other specified motor vehicle is driven on the specified shared path at any point in time;
(g)there is in force a policy of insurance in relation to the specified motor vehicle insuring against any liability in respect of the death of or bodily injury sustained by any person, or property damage suffered by any person, caused by or arising out of the use of the specified motor vehicle;
(h)the risk under the policy of insurance mentioned in sub‑paragraph (g) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
