Carriage by Air (Montreal Convention, 1999) Act

Carriage by Air (Montreal Convention, 1999) (Revision of Limits of Liability) Order 2009
In exercise of the powers conferred by section 7 of the Carriage by Air (Montreal Convention, 1999) Act, the Minister for Transport hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Carriage by Air (Montreal Convention, 1999) (Revision of Limits of Liability) Order 2009 and shall come into operation on 30th December 2009.
Amendment of Schedule
2.  The Schedule to the Carriage by Air (Montreal Convention, 1999) Act is amended by appending, immediately after the text of the Convention, the following addendum:
“ADDENUM
REVISED LIMITS OF LIABILITY
UNDER ARTICLES 21 AND 22
The limits of liability prescribed in Articles 21 and 22 have, following a review by the Depositary and its Notification to States Parties in accordance with paragraph 2 of Article 24, been revised and shall, with effect from 30th December 2009, be as follows:
Provision in Convention
 
Revised Limits of Liability (Special Drawing Rights)
Article 21, paragraph 1
 
In the case of death or bodily injury of a passenger
 
113,100 per passenger
Article 22, paragraph 1
 
In the case of delay in the carriage of persons
 
4,694 per passenger
Article 22, paragraph 2
 
In the case of destruction, loss, damage or delay with respect to baggage
 
1,131 per passenger
Article 22, paragraph 3
 
In the case of destruction, loss, damage or delay with respect to cargo
 
19 per kilogram of cargo.
”.
