(Revision of Limits of Liability) Order 2019

In exercise of the powers conferred by section 7 of the Carriage by Air (Montreal Convention, 1999) Act, the Minister for Transport makes the following Order:

Citation and commencement

1. This Order is the Carriage by Air (Montreal Convention, 1999) (Revision of Limits of Liability) Order 2019 and comes into operation on 28 December 2019.

Amendment of Schedule

2. The Schedule to the Carriage by Air (Montreal Convention, 1999) Act is amended by appending, immediately after the addendum to the text of the Convention, the following addendum:

“SECond ADDENDUM

revised limits of liability
under articles 21 and 22

The limits of liability prescribed in Articles 21 and 22 have, following a review by the Depositary and its Notification to States Parties in accordance with paragraph 2 of Article 24, been revised and shall, with effect from 28 December 2019, be as follows:

Provision in Convention

Revised Limits of Liability (Special Drawing Rights)

Article 21, paragraph 1

In the case of death or bodily injury of a passenger

128,821 per passenger

Article 22, paragraph 1

In the case of delay in the carriage of persons

5,346 per passenger

Article 22, paragraph 2

In the case of destruction, loss, damage or delay with respect to baggage

1,288 per passenger

Article 22, paragraph 3

In the case of destruction, loss, damage or delay with respect to cargo

22 per kilogram of cargo.

”.
