Worshipper capacities
5.—(1)  For a religious gathering conducted for a congregational worship in a venue that is or is within a place of worship, the worshipper capacity is —
(a)where the venue is a restricted place within the meaning of the Infectious Diseases (COVID-19 Access Restrictions and Clearance) Regulations 2021, and every worshipper at the religious gathering has a cleared status during the crowd management period of the religious gathering — the lower of the following:
(i)1,000;
(ii)the COVIDSAFE capacity of the venue; or

(b)in any other case — the lower of the following:
(i)50;
(ii)the COVIDSAFE capacity of the venue.

(2)  For a religious gathering conducted for a congregational worship in a venue that is not and not within a place of worship, the worshipper capacity is —
(a)50; or
(b)the COVIDSAFE capacity of the venue, if it is lesser in number than sub‑paragraph (a).
(3)  For a private religious gathering taking place in a venue, the worshipper capacity is —
(a)50; or

(b)the COVIDSAFE capacity of the venue, if it is lesser in number than sub‑paragraph (a).
