Citation and commencement |
1. These Regulations may be cited as the Consumer Protection (Fair Trading) (Regulated Financial Products and Services) Regulations 2009 and shall come into operation on 15th April 2009. |

3. The Act shall apply with the modifications prescribed in these Regulations. |
Considerations in determining unfair practice |
4.—(1) For the purposes of section 5(3)(a) of the Act, a court may, in considering the reasonableness of the actions of a supplier of regulated financial products or services, take into account the inherent risks of the financial products or services supplied, if all relevant information concerning such risks has been provided to the consumer in good faith.

Multiple actions |
5.—(1) In any action under section 6(1) of the Act involving an unfair practice relating to the supply of regulated financial products or services, the amount of the claim or the value of the subject-matter for the purposes of section 6(2) shall be determined based on the aggregate amounts of the claims or the aggregate values of the subject-matters (as the case may be) in —

Specified dispute resolution scheme |
6. For the purposes of section 7(10) of the Act, the dispute resolution scheme provided by the Financial Industry Disputes Resolution Centre Ltd shall be the specified dispute resolution scheme in respect of disputes relating to MAS-regulated financial products or services supplied by a subscriber to that dispute resolution scheme. |
Application of sections 8 and 9 of Act |
7. Sections 8 (Voluntary compliance agreement) and 9 (Declaration or injunction) of the Act shall not apply to any unfair practice relating to MAS-regulated financial products or services. |
