Co-operative Societies
(Exemption under Section 96)
Order 2012
In exercise of the powers conferred by section 96 of the Co-operative Societies Act, MG (NS) Chan Chun Sing, Minister of State, charged with the responsibility of the Minister for Community Development, Youth and Sports, hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Co-operative Societies (Exemption under Section 96) Order 2012 and shall come into operation on 12th July 2012.
Exemption
2.  Subject to paragraph 3, the proposed secondary society to be called NTUC Social Capital Co-operative Limited (referred to in this Order as the NSC), is exempted from —
(a)the requirement in section 5(b) of the Act that a secondary society is to consist only of societies or trade unions qualifying for membership under section 39(2) of the Act; and
(b)the requirements in section 7(1)(b) of the Act.
Exemption conditions
3.—(1)  The exemption under paragraph 2(a) is subject to the condition that the Singapore Labour Foundation established under the Singapore Labour Foundation Act (Cap. 302) will be the only member of the NSC who does not qualify for membership under section 39(2) of the Act.
(2)  The exemption under paragraph 2(b) is subject to the condition that the NSC’s application for registration as a secondary society must be signed at least by one person duly authorised in that behalf by a proposed member who need not be a society qualifying for membership under section 39(2) of the Act.
