Essential (Air Navigation Restriction) Regulations

Citation

1. These Regulations may be cited as the Essential (Air Navigation Restriction) Regulations.

Definitions

2. In these Regulations —

“competent authority” means the Chief of the Armed Forces Staff or any person appointed by him in that behalf;

“Minister” means the Minister charged with the responsibility for transport;

“prescribed” means prescribed in notifications and instructions issued from time to time by the Director-General of Civil Aviation.

Aircraft prohibited from flying over Singapore without permission

3. During the continuance in force of the Act, no aircraft other than aircraft of the Singapore Armed Forces or of any visiting force lawfully present in Singapore shall fly over, land in or take-off from any place in Singapore or in the islands or territorial waters thereof except with prior permission obtained in the prescribed manner to do so and in accordance with the prescribed conditions.

Power of competent authority to authorise interception, detention and firing upon aircraft contravening regulation 3

4. It shall be lawful for the competent authority to cause any aircraft contravening regulation 3 to be intercepted and detained, or if detention is impracticable, to be fired upon; and any aircraft so detained shall be disposed of as the Minister may direct.

Penalties

5. If an aircraft contravenes regulation 3, every member of the operating crew thereof shall be guilty of an offence and shall be liable on conviction to imprisonment for a term not exceeding 6 months and a fine not exceeding $2,000.
