Management (Prescribed Regulated Goods)
Order 2022
In exercise of the powers conferred by section 40B of the Environmental Protection and Management Act 1999, the Minister for Sustainability and the Environment, after consulting the National Environment Agency, makes the following Order:
Citation and commencement
1.  This Order is the Environmental Protection and Management (Prescribed Regulated Goods) Order 2022 and comes into operation on 1 October 2022.
Definitions
2.  In this Order —
“substitute chiller” means a chiller supplied pursuant to an agreement mentioned in paragraph 3(b)(ii)(B) or 4(b)(i), to take the place of any chiller (X) earlier supplied under that agreement, upon the end of the service life of X, as an upgrade of X, or in accordance with any schedule that was agreed upon, where X may or may not be the first chiller supplied under that agreement;
“warranty” means a warranty given by a supplier of a chiller against defects in the components and workmanship in the chiller, and promising, if the chiller is defective, to repair or replace the chiller within the period specified in the warranty.
Regulated goods for supply
3.  The following goods are regulated goods for the purposes of section 40D(1)(a) of the Act:
(a)any air‑conditioner described in Part 1 of the First Schedule, from (and including) the date specified opposite that air‑conditioner, but not if —
(i)the air‑conditioner is a second‑hand air‑conditioner; or
(ii)the air‑conditioner (not being a second‑hand air‑conditioner) —
(A)was imported into or manufactured in Singapore before 1 October 2022, and is supplied between 1 October 2022 and 30 September 2023 (both dates inclusive);
(B)is supplied pursuant to an agreement entered into before 31 March 2022; or
(C)is supplied between 1 October 2022 and 30 September 2023 (both dates inclusive) pursuant to an agreement entered into on or after 31 March 2022 but before 1 October 2022;
(b)any chiller described in Part 1 of the Second Schedule, from (and including) the date specified opposite that chiller, but not if —
(i)the chiller is a second‑hand chiller; or
(ii)the chiller (not being a second‑hand chiller) —
(A)was imported into or manufactured in Singapore before 1 October 2022, and is supplied between 1 October 2022 and 30 September 2023 (both dates inclusive);
(B)is supplied pursuant to an agreement entered into before 1 October 2022 and is not a substitute chiller; or
(C)is supplied pursuant to a warranty in the agreement under which a chiller mentioned in sub‑paragraph (A) or (B) is supplied, as a replacement of the same brand and model as that chiller;
(c)any refrigerator described in Part 1 of the Third Schedule, from (and including) the date specified opposite that refrigerator, but not if —
(i)the refrigerator is a second‑hand refrigerator; or
(ii)the refrigerator (not being a second‑hand refrigerator) —
(A)was imported into or manufactured in Singapore before 1 October 2022, and is supplied between 1 October 2022 and 30 September 2023 (both dates inclusive);
(B)is supplied pursuant to an agreement entered into before 31 March 2022; or
(C)is supplied between 1 October 2022 and 30 September 2023 (both dates inclusive) pursuant to an agreement entered into on or after 31 March 2022 but before 1 October 2022.
Regulated goods imported for own use
4.  Chillers described in Part 1 of the Second Schedule are regulated goods from (and including) the date specified opposite such chillers for the purpose of section 40D(1)(b) of the Act, but not any of the following chillers:
(a)a chiller that is a second‑hand chiller;
(b)a chiller (not being a second‑hand chiller) that is imported by a person for the person’s own use and —
(i)is supplied to the person under an agreement entered into before 1 October 2022 and is not a substitute chiller; or
(ii)is supplied pursuant to a warranty in the agreement under which a chiller mentioned in sub‑paragraph (i) is supplied, as a replacement of the same brand and model as that chiller.

Definitions
In this Schedule —
“single‑phase non‑ducted room air‑conditioner” means an encased assembly or assemblies of one or more evaporators, compressors and condensers, designed to be used together as a permanently installed piece of equipment to provide conditioned air to any enclosed space, and —
(a)includes a prime source of refrigeration for cooling and dehumidification; and
(b)may include other means for dehumidifying, circulating and cleaning the air in the enclosed space;
“single‑phase variable refrigerant flow (VRF) air‑conditioner” means an encased assembly or assemblies of one or more evaporators, compressors and condensers, designed to be used together as a permanently installed piece of equipment to provide conditioned air to any enclosed space, that satisfies all of the following:
(a)the equipment is of the variable refrigerant flow type;
(b)the equipment has one outdoor unit that services a network of indoor units;
(c)the outdoor unit of the equipment is connected to a single common refrigerant pipe, which in turn branches out to connect to each of the indoor units of the equipment;
(d)the number of indoor units is not limited by the number of connectors on the outdoor unit that may be connected to the common refrigerant pipe;
(e)the equipment uses a single‑phase power supply;
“split type (inverter) air‑conditioner”, in relation to a single‑phase non‑ducted room air‑conditioner, means such air‑conditioner having an assembly of components of a refrigeration system fixed on 2 or more mountings to form a matched functional unit that employs technologies that vary the output of the compressor, by means other than start‑stop operation;
“split type (non‑inverter) air‑conditioner”, in relation to a single‑phase non‑ducted room air‑conditioner, means such air‑conditioner having an assembly of components of a refrigeration system fixed on 2 or more mountings to form a matched functional unit that employs technologies that control the output of the compressor by start‑stop operation.
