Citation
1.  This Notification may be cited as the Housing and Development (Maintenance Fees and Rent — Commercial and Industrial Properties and Hawker Stalls) Notification.
Definitions
2.  In this Notification —
“agreement” includes any tenancy agreement, licence agreement, agreement for lease or lease entered into between the Board and any tenant, licensee, purchaser, lessee or owner;
“maintenance fees” means the service and conservancy charges payable to the Board by any tenant, licensee, purchaser, lessee or owner in respect of any commercial or industrial property or stall sold, leased, licensed or otherwise provided by the Board under the Act;
“commercial property” includes any building or premises or part thereof sold, leased or licensed by the Board for the purposes of carrying on any business or trade;
“industrial property” includes any building or premises or part thereof sold, leased or licensed by the Board for industrial purposes;
“stall” means a stall in a market or hawker centre.
Maintenance fees
3.—(1)  The maintenance fees payable for any commercial or industrial property or stall managed by the Board shall be the amount determined in accordance with the rates set out in the Schedule.
(2)  Where any commercial or industrial property specified in the Schedule includes living accommodation, the maintenance fees payable for that property determined in accordance with sub-paragraph (1) shall be payable in addition to the maintenance fees payable for that living accommodation prescribed by the Housing and Development (Variation of Maintenance Fees for Residential Properties) Notification (N 2).
(3)  The maintenance fees referred to in sub-paragraph (1) shall be payable in addition to the rent payable to the Board under the terms of any agreement in respect of any commercial or industrial property or stall sold, leased or licensed by the Board.
(4)  The acceptance of any maintenance fees for any commercial or industrial property or stall sold, leased or licensed by the Board shall be without prejudice to any right of action or other remedy of the Board in respect of any antecedent breach by the tenant, licensee, purchaser or owner under any agreement with the Board.
Rent
4.  Until such time as the Board exercises its powers to revise the rent payable for any commercial or industrial property which were sold, leased or licensed by the Board prior to 1st March 1989, the owner, lessee or licensee, as the case may be, shall continue to pay rent to be computed in accordance with the rates prescribed by the Housing and Development (Variation of Rent and Maintenance Fees — Commercial and Industrial Properties) Notification 1989, revoked by this Notification, as if that Notification had not been revoked.
