Notification and advertisement of appointment of replacement judicial manager
55.—(1) If a judicial manager is appointed under section 98(1) or 104(5) of the Act or an interim judicial manager is appointed under section 98(1) of the Act, the judicial manager or interim judicial manager (as the case may be) must —
(a)
lodge with the Registrar of Companies a copy of the order of the Court within 3 days after the date of the order; and
(b)
send to every creditor of the company (so far as the creditor’s address is known) a notice of the order of the Court in accordance with Form JM‑16 within 28 days after the date of the order.
(2) If a judicial manager is appointed under section 98(2) of the Act, the judicial manager must —
(a)
lodge with the Registrar of Companies a written notice of the appointment within 3 days after the date of his or her appointment; and
(b)
send to every creditor of the company (so far as the creditor’s address is known) a written notice of the appointment within 28 days after the date of his or her appointment.
(3) The written notice mentioned in paragraph (2) must be given in accordance with Form JM‑17.
