Parking Places Rules

Citation

1. These Rules may be cited as the Parking Places Rules.

Definitions

2. In these Rules, unless the context otherwise requires —

“authorised period” means the period for which the prescribed parking charge has been paid for the parking of a vehicle;

“motor lorry” means a motor vehicle (not being a motor car), the weight of which unladen exceeds 1,800 kilograms;

“motor vehicle” means a mechanically propelled vehicle intended or adapted for use on roads;

“parking lot” means the space marked out in a parking place for the parking of one vehicle;

“parking ticket” means a ticket, card or other document whether issued through a ticket dispenser or otherwise for the parking of a vehicle in a parking place;

“parking warden” means any person who is authorised by the Superintendent to perform the duties and to exercise the powers of a parking warden under these Rules;

“payment station” means any place designated by the Superintendent in or near a parking place for the collection of parking charges through a machine or by an authorised officer;

“reserved parking lot” means the space marked out in a parking place for the parking of any vehicle authorised by the Superintendent;

“restricted parking place” means a parking place wherein no vehicle is allowed to be parked for a period of more than two hours at any one time;

“road” means any public road and any other road to which the public has access;

“season parking card” means the official card issued by the Superintendent for the parking of a vehicle in a specified season parking place;

“season parking place” means a parking place, so designated by written notice, traffic signs, road markings or in any other manner, where vehicles with valid season parking tickets may be parked;

“season parking ticket”, in relation to a vehicle, means —

(a)	the official receipt or any other document issued by the Superintendent showing the registration number of the vehicle, and the amount of the prescribed parking charge for the parking of the vehicle in a specified season parking place for a period of time specified in the official receipt or document; or
(b)	any other form of validation issued by the Superintendent for the parking of the vehicle in a specified season parking place for such period of time as approved by the Superintendent;

“whole day parking place” or “per entry parking place” means a parking place so designated by written notice on one or more signboards or in any other manner wherein a vehicle may be parked for a whole day or by reason of a single entry as the case may be in such parking place on payment of the prescribed parking charge.

Parking places

2A.—(1) The Superintendent may place or erect at or near the entrance of any parking place a parking sign in accordance with any of the diagrams set out in the Second Schedule for the purpose of indicating that such parking place is a parking place provided under section 4 of the Act.

(2) No person shall place or erect any sign for the parking of any vehicle at any parking place without the prior written consent of the Superintendent.

(3) All plans designating parking places shall be approved by the Superintendent and shall be available for inspection by the public free of charge during normal office hours at the office of the Deputy Superintendent of Car Parks (Housing and Development Board) or at the office of the Deputy Superintendent of Car Parks (Urban Redevelopment Authority).

(4) The list of roads approved by the Superintendent for the parking of vehicles shall be available for inspection by the public free of charge during normal office hours at the office of the Deputy Superintendent of Car Parks (Urban Redevelopment Authority).

Prohibition

3. No person shall park a vehicle in any parking place other than in a parking lot.

General rules relating to parking places

4.—(1) No person shall make use of a parking place for any purpose other than for the parking of vehicles without the prior written consent of the Superintendent.

(2) The Superintendent may allow any person to use a parking place for any purpose other than for the parking of vehicles on such conditions and on payment of such charges as may be determined by the Superintendent.

(3) No person shall obstruct or cause any obstruction to a parking place or any parking lot with any vehicle, material or object.

(4) The Superintendent may remove the vehicle, material or object which is the cause of the obstruction and may detain the vehicle, material or object and any such vehicle, material or object shall remain at the risk of the owner and the person offending until all the fines, charges and expenses payable under these Rules have been paid.

(5) The owner of any vehicle, material or object removed and detained by the Superintendent under paragraph (4) may within 30 days of such removal and detention claim from the Superintendent possession thereof upon payment to the Superintendent of the cost of the removal and the detention thereof and any other charges payable under these Rules.

(6) Where any material or object removed by the Superintendent is of a perishable nature or where any vehicle, material or object removed by the Superintendent is not claimed by the owner within 30 days of its removal the Superintendent may dispose of the vehicle, material or object by public auction or otherwise and may apply the proceeds of sale thereof in payment of the charges referred to in paragraph (5).

Surplus proceeds

5. Any surplus money remaining from the proceeds of the sale or disposal of the vehicle, material or object under rule 4(6) shall be returned to the owner of such vehicle, material or object.

Liability

6. The Superintendent shall not be liable for any damage caused to the said vehicle, material or object in the course of its removal and whilst in the custody of the Superintendent.

Payment

7.—(1) Any person using a parking place during the times specified on the signs for the parking of any vehicle shall pay the prescribed parking charge at the payment station at that parking place or through any other mode of payment provided at the parking place immediately prior to the removal of his vehicle from that parking place.

(2) Where the prescribed parking charge has not been paid in accordance with paragraph (1), the parking charge shall be paid to the Superintendent within 7 days of the parking.

Payment for parking beyond paid period

8.—(1) Where a person using a parking place is required to obtain a parking ticket prior to the entry of his vehicle into such parking place, that person shall surrender the parking ticket to the parking warden on duty immediately prior to the removal of his vehicle from such parking place.

(2) Any person who fails to surrender the parking ticket to the parking warden on duty at such parking place or at the payment station in accordance with paragraph (1) shall pay to the parking warden on duty a charge equivalent to the charge for a whole day’s parking for each day or part thereof the vehicle remained at that parking place immediately prior to the removal of his vehicle from that parking place.

(3) The Superintendent may waive or reduce the charge payable by any person under paragraph (2) if it is shown to his satisfaction that the failure to comply with paragraph (1) is not due to any negligence or fault on the part of such person.

(4) Where the charge or reduced charge is not paid immediately prior to the removal of the vehicle from that parking place, it shall be paid to the Superintendent within 7 days of the parking.

(5) Any person who fails to pay the charge or reduced charge within the time specified in paragraph (4) shall be guilty of an offence.

Change of parking lot

9. No person, having parked a vehicle in a parking lot, shall remove that vehicle to another parking lot within the same parking place on or before the expiry of the initial period of parking where the prescribed parking charge for the subsequent period is more than the initial charge.

Parking in designated lots

10.—(1) No person shall park any vehicle in any parking place which is not specially designated for the use of that class of vehicle, unless otherwise approved by the Superintendent.

(2) Paragraph (1) shall not apply to any motor lorry the driver of which is authorised to park for the purpose of immediately loading or unloading of goods on payment of the prescribed parking charges for the number of parking lots occupied by the motor lorry.

(3) No person shall park any motor lorry in a parking place outside the operational hours of any parking place without the prior approval of the Superintendent.

Orderly parking

11.—(1) No vehicle shall be drawn, driven, pushed or parked within a parking place otherwise than in an orderly manner and with due regard to the safety of other vehicles, property and persons within the parking place.

(2) No unauthorised person shall push or remove any vehicle parked in any parking place without the permission of the owner or the driver of the vehicle.

(3) No person shall park any vehicle in any parallel parking lot in any road except in the same direction as the traffic may lawfully move.

(4) In this rule, “parallel parking lot” means a parking lot in a parking place, which is part of a road, marked out for the parking of a vehicle parallel with and close to the edge of the roadway.

Damage to signs

12.—(1) Any person driving or parking a vehicle within a parking place shall obey all the signs exhibited in the parking place.

(2) The driver of a vehicle which causes damage to any sign or property belonging to the Government, the Authority or any other statutory body in any parking place shall make good the damaged sign or property to the Government, the Authority or the statutory body as the case may be.

(3) In this rule, the word “sign” includes all signals, warning signs, direction signs or other devices displayed or indicated for the guidance or direction of persons driving vehicles within a parking place.

Obstructive parking

13. No person shall park any vehicle in such a manner as to cause the vehicle to protrude beyond the boundary lines of the parking lot, or to obstruct the entrance to or exit of a parking lot or a parking place, nor shall he park or stop his vehicle so as to obstruct or prevent the smooth circulation of traffic in or around such parking place.

Unauthorised activity in parking place

14. No person without the prior written permission of the Superintendent shall, within any parking places, —

(a)	repair, or permit to be repaired, any vehicle, except in cases where repair is necessary to enable the vehicle to be removed from the parking place;
(b)	use any vehicle for the sale of or for promoting the sale of any goods, article or thing whatsoever;
(c)	wash or clean or cause or permit to be washed or cleaned any vehicle;
(d)	use any vehicle for the conduct of driving lessons or training; or [S 378/2008 wef 28/07/2008]
(e)	carry out or conduct any business or provide any services of whatsoever nature, whether or not for reward. [S 378/2008 wef 28/07/2008]

Loitering

15. No person, other than parking wardens and those having legitimate business in a parking place, shall remain in such parking place.

Authority of parking warden

16.—(1) Any person using a parking place for the parking of any vehicle shall obey all lawful directions given to him by any parking warden on duty at such parking place.

(2) Where it appears to the parking warden on duty that any person using a parking place has in connection with such use contravened any provision under these Rules or any rules made under the Act, such person shall, if required by the parking warden, provide proof of his identity.

(3) Any person who fails to comply with the requirements under paragraph (1) or (2) or who gives false proof of his identity shall be guilty of an offence.

Refusal to issue season ticket

17. The Superintendent may issue or refuse to issue a season parking ticket without assigning any reason.

Parking in a season parking place

18.—(1) No person shall park in any season parking place unless he is in possession of a season parking ticket for such parking place or is authorised by the Superintendent so to park.

(2) Any person using a season parking place shall display the season parking ticket, which shall be visible for inspection at all times, on the front windscreen of the motor vehicle, and where the vehicle is a motor cycle the season parking ticket shall be displayed in a conspicuous position on the motor cycle.

(3) No person shall display on a vehicle a season parking ticket that has any alteration, erasure or other irregularity therein which indicates that the season parking ticket has been tampered with.

(4) For the purposes of these Rules, the Superintendent or any person authorised by him may require the driver of a vehicle parked in a season parking place to produce for his inspection the season parking ticket displayed on such vehicle and may retain that season parking ticket.

(5) If the driver of such vehicle fails or refuses to produce the season parking ticket of the vehicle for inspection or retention by the Superintendent or any person authorised by him in accordance with paragraph (4), he shall be guilty of an offence.

Season parking card to be inserted into ticket dispenser

19. The driver of a vehicle who holds any season parking card shall, before entering or leaving a parking place, be required to insert the season parking card into a ticket dispenser or reader when he enters or leaves the parking place.

Withdrawal of parking facilities from season ticket holder

20. The Superintendent may at any time withdraw parking facilities from any season parking ticket holder without assigning any reason. In such event, the Superintendent may refund to the holder of the season parking ticket the sum representing the charge for the unexpired period for which the parking ticket has been issued.

Refunds and rebates for season ticket holders

20A. The Superintendent may, in circumstances where he considers appropriate —

(a)	upon the voluntary surrender of any unexpired season parking ticket, refund to the holder of the season parking ticket a sum equal to the charge for the unexpired period for which the season parking ticket has been issued; or
(b)	grant a rebate of any amount to any holder of a season parking ticket of the parking charges payable for the season parking ticket. [S 454/93 wef 01/12/1993]

Lost, etc., season tickets

21. The holder of any season parking ticket shall inform the Superintendent whenever his season parking ticket or card has been lost, destroyed, defaced or the particulars thereon have become illegible, and shall obtain a duplicate thereof. The fee for a duplicate season parking ticket or card shall not exceed $20.

Temporary closures

22. The Superintendent may suspend the use of a parking place or any part thereof and cause it to be used for public functions.

Costs

27. All costs and expenses incurred in the recovery of any sum due under these Rules may be recovered as if they formed part of the sum due.

Reserved parking lots

29.—(1) No person shall park in any reserved parking lot unless he is authorised by the Superintendent and unless such authorisation is displayed on the front windscreen of the motor vehicle, and where the vehicle is a motor-cycle, such authorisation is displayed in a conspicuous position on the motor cycle.

(2) No person shall display on a vehicle any authorisation that has any alternation, erasure or other irregularity therein which indicates that the authorisation has been tampered with.

(3) For the purposes of these Rules, the Superintendent or any person authorised by him may require any driver of a vehicle parked in a reserved parking place to produce for his inspection the authorisation displayed on such vehicle and may retain the authorisation.

(4) If the driver of the vehicle fails or refuses to produce the authorisation to the Superintendent or any person authorised by him for inspection or retention in accordance with paragraph (3), he shall be guilty of an offence.

Restricted parking place

30. Any person who parks any vehicle for more than two hours in any parking place which has been declared in the Gazette to be a restricted parking place shall pay to the Superintendent the prescribed parking charge and a surcharge of $10 for every hour or a fraction of an hour of parking after the expiry of the said two hours within 7 days of the parking.

Excess payments and refunds

31.—(1) Any refund of excess payment made by the Superintendent shall be made to the person who made the payment.

(2) If the identity of the person in paragraph (1) is unknown to the Superintendent, he may request the owner of the relevant vehicle to provide information on the identity of such person and the refund under paragraph (1) shall be made to the person identified by the owner unless the Superintendent has reason to believe he is not the person who made the payment.

(3) The owner of the vehicle shall be guilty of an offence if he willingly provides false or misleading information under paragraph (2).

(4) No refund of excess payment shall be made where —

(a)	the identity of the person who made the payment is unknown to the Superintendent and the owner of the vehicle has not provided the necessary information within the time specified by the Superintendent; or
(b)	the owner has identified the person and no claim has been received by the Superintendent from that person within the time specified by the Superintendent to him.
