3.—(1) Section 110(1)(a) of the Act does not apply to an individual who drives a self‑drive private hire car (called the driver) if —
(a)
the driver is —
(i)
the holder of the public service vehicle licence for the car or an individual who is authorised by the holder of such a licence to drive the car; or
(ii)
the hirer of the car under a contract for use as a self‑drive private hire car or an individual authorised by the hirer in the contract to drive the car personally; and
(b)
the car is used only to convey the driver, with or without any passengers, in a journey to a destination without reward to the driver for that journey.
(2) Rule 6 of the Road Traffic (Public Service Vehicles) Rules (R 14) does not apply to the holder of a public service licence for a self‑drive private hire car when the car is driven by an individual mentioned in sub‑paragraph (1)(a)(i) or (ii) in the circumstances mentioned in sub‑paragraph (1)(b).
