(Volvo Diesel Hybrid Bus Trial)
(Exemption) Order 2016
In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Transport makes the following Order:
Citation
1.  This Order is the Road Traffic (Volvo Diesel Hybrid Bus Trial) (Exemption) Order 2016.
Definitions
2.  In this Order —
“bus service licence” means a bus service licence that is granted (or is deemed granted) under Part 3 of the Bus Services Industry Act 2015 (Act 30 of 2015);
“DHB” means the Volvo B5RH diesel hybrid bus which —
(a)is distributed in Singapore by Volvo; and
(b)is used by SBST or Volvo during the conduct of the Volvo Diesel Hybrid Bus Trial for the purposes of testing and developing the use of diesel hybrid technology in omnibus operations;
“qualified person” means an individual —
(a)who holds a vocational licence granted under section 110 of the Act authorising the individual to drive an omnibus;
(b)who has completed a course designed to familiarise the individual with operating the DHB; and
(c)who is adequately trained to operate the DHB;
“relevant period” means the period from 12 February 2016 to 28 August 2016 (both dates inclusive);
“SBST” means SBS Transit Ltd;
“specified bus service” means SBST bus service 13, 13A, 21, 21A, 26, 29, 29A, 38, 45, 45A, 54, 63, 70, 70A, 70B, 70M, 73, 124, 130, 131, 131A, 135, 135A, 139, 145, 145A, 155, 155A, 162, 162M, 222, 222A, 265, 268, 268A, 269, 269A, 293, 410G or 410W;
“specified route” means the route or routes on which a specified bus service is provided by SBST in accordance with its bus service licence;
“Volvo” means the company incorporated under the Companies Act (Cap. 50) as Volvo East Asia (Pte) Ltd (Registration No. 197901793K).
Exemption
3.—(1)  Subject to sub‑paragraph (2), rules 75(3) and 77(1)(d) and Part IIIA of the Road Traffic (Motor Vehicles, Construction and Use) Rules (R 9) do not apply to or in relation to the DHB that is used by any qualified person on any road along the specified route during the relevant period.
(2)  The exemption in sub‑paragraph (1) is subject to the following conditions:
(a)there is in force, at any time the DHB is used on any road along the specified route, a policy of insurance in relation to the use of the DHB insuring against any liability in respect of the death of, or bodily injury sustained by, any person caused by or arising out of the use of the DHB;
(b)the risk under the policy of insurance referred to in sub‑paragraph (a) is assumed by an insurer who, at the time of issuance of the policy, is lawfully carrying on insurance business in Singapore.
