Road Traffic (Amendment) Act 2010

Road Traffic (Saving and Transitional Provisions) Rules 2010
In exercise of the powers conferred by section 23 of the Road Traffic (Amendment) Act 2010, the Minister for Home Affairs hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Saving and Transitional Provisions) Rules 2010 and shall come into operation on 1st November 2010.
Definitions
2.  In these Rules —
“excluded vehicle” and “expressway” have the same meanings as in the Road Traffic (Expressway Traffic) Rules (R 23) in force immediately before 1st November 2010;
“former section 116(1)” and “former section 116(3)” mean, respectively, section 116(1) and section 116(3) of the Road Traffic Act in force immediately before 1st November 2010;
“new section 116(1)”, “new section 116(2)”, “new section 143(1)”, “new section 143(2)” and “new section 143(3)” mean, respectively, section 116(1), section 116(2), section 143(1), section 143(2) and section 143(3) of the Road Traffic Act in force as from 1st November 2010;
“revoked”  —
(a)in rule 4, means revoked by the Road Traffic (Amendment) Rules 2010 (G.N. No. S 635/2010); and
(b)in rule 5, means revoked by the Road Traffic (Expressway Traffic) (Amendment) Rules 2010 (G.N. No. S 649/2010).
Saving and transitional provisions relating to sections 116 and 143 of Road Traffic Act
3.—(1)  Any written approval granted by the Minister before 1st November 2010 under the former section 116(1) for any competition or trial of speed that is to take place on or after that date shall be deemed to be a permit granted by the Deputy Commissioner of Police under the new section 116(1).
(2)  Any order made by the Minister before 1st November 2010 under the former section 116(3) regulating or restricting the use of any road or part thereof for the purposes of any competition or trial of speed that is to take place on or after that date shall be deemed to be a police order issued by the Deputy Commissioner of Police under the new section 143(2).
(3)  Where any application for the written approval of the Minister under the former section 116(1) that has been made before 1st November 2010 is pending on that date, such application shall be deemed to be an application made to the Deputy Commissioner of Police —
(a)under the new section 116(2) for a permit referred to in the new section 116(1); and
(b)under the new section 143(3) for a permit referred to in the new section 143(1),
and the application shall be dealt with by the Deputy Commissioner of Police accordingly under those new sections.
Saving and transition provision relating to revocation of rule 16 of Road Traffic Rules
4.—(1)  Where before 1st November 2010 the Deputy Commissioner of Police has, by the grant of a permit allowed, pursuant to the revoked rule 16(2) of the Road Traffic Rules (R 20) —
(a)any vehicle the overall width of which exceeds 2.6 metres to be used on a road on or after that date; or
(b)any load or covering placed over a load on any vehicle that is to be used on a road on or after that date to exceed the requirements specified in the revoked rule 15 of those Rules,
such permit shall, as from that date, continue to be valid until the time of its expiration or until it is sooner cancelled by the Deputy Commissioner of Police, and the revoked rule 16 of the Road Traffic Rules shall, until the expiration or cancellation of the permit, continue to apply to the holder of the permit and any person using the vehicle in respect of which the permit was granted, as if the Road Traffic (Amendment) Rules 2010 (G.N. No. S 635/2010) had not been enacted.
(2)  If during the time when a permit referred to in paragraph (1) remains valid on or after 1st November 2010 the holder of the permit or any person using the vehicle in respect of which the permit has been granted commits an offence under paragraph (3) of the revoked rule 16 of the Road Traffic Rules, the Deputy Commissioner of Police may —
(a)commence and conduct an investigation into the commission of the offence;
(b)compound the offence in accordance with section 135 of the Road Traffic Act; or
(c)initiate the prosecution of that offence,
as if the Road Traffic (Amendment) Rules 2010 had not been enacted.
Saving and transition provision relating to revocation of rule 11 of Road Traffic (Expressway Traffic) Rules
5.  Where before 1st November 2010 the Deputy Commissioner of Police has authorised, under the revoked rule 11(3) or (4)(a) of the Road Traffic (Expressway Traffic) Rules (R 23), any excluded vehicle to use an expressway or any part thereof on or after that date, such authorisation shall, as from that date, continue to be valid until the time of its expiration, as if the Road Traffic (Expressway Traffic) (Amendment) Rules 2010 (G.N. No. S 649/2010) had not been enacted.
