Power to detain or remove vehicles
4.—(1)  Where a vehicle is parked on common property in contravention of these By-laws, the Town Council or its officers, employees or agents may detain the vehicle by any means.
(2)  The Town Council shall give notice in writing to the owner or person having lawful possession of the detained vehicle.
(3)  The owner or person having lawful possession of the vehicle detained shall, within 3 days of the notice served on him by the Town Council, pay all expenses incurred by the Town Council as a result of the detention. The vehicle so detained shall remain at the risk of the owner or person having lawful possession of the vehicle until all expenses have been paid.
(4)  Where any vehicle so detained by the Town Council is not claimed by the owner or person having lawful possession within 7 days of the notice served on him, the Town Council or its officers, employees or agents may remove the vehicle to a place of safety.
(5)  The Town Council shall give a notice in writing of the removal to the owner or person having lawful possession of the vehicle.
(6)  The owner or person having lawful possession of the vehicle removed shall, within 30 days of the notice served on him by the Town Council, pay all expenses incurred by the Town Council as a result of the removal. The vehicle so removed and kept in the custody of the Town Council shall remain at the risk of the owner or person having lawful possession of the vehicle until all expenses have been paid.
(7)  The Town Council or its officers, employees or agents shall not be liable for any damage caused to the vehicle in the course of its detention, removal and whilst in the custody of the Town Council.
