Calculation of penalties for conservancy and service charges or licence fees in arrears
2.—(1) Where any (or a part of any) conservancy and service charge or licence fee payable in respect of any residential, commercial or communal property by any tenant, owner or licensee to the Town Council is in arrears, the tenant, owner or licensee, as the case may be, shall be liable to pay to the Town Council in respect of the first month, and for every month thereafter, in which such charge or licence fee or any part thereof is due and unpaid, a penalty calculated at the rate of —
(a)
in the case of any residential property — 2% on the amount due and unpaid each such month subject to a minimum amount of $1; or
(b)
in the case of any commercial or communal property — 5% on the amount due and unpaid each such month subject to a minimum amount of $5.
(2) A penalty determined in accordance with paragraph (1) for any month in which any conservancy and service charge or licence fee or any part thereof is in arrears shall be due and payable on the last day of the month and shall be accumulative until payment of such charge or licence fee or part thereof in arrears is made by the tenant, owner or licensee, as the case may be.
(3) In paragraph (1), “first month” means the first month following a period of at least one month where the conservancy and service charge or licence fee, as the case may be, is not in arrears.
