Town Council of Pasir Ris-punggol (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws 2002
In exercise of the powers conferred by section 24 (2)(a) and (c) of the Town Councils Act, the Town Council for the Town of Pasir Ris-Punggol hereby makes the following By-laws:
Citation and commencement
1.  These By-laws may be cited as the Town Council of Pasir Ris-Punggol (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws 2002 and shall come into operation on 6th February 2002.
Calculation of penalties for conservancy and service charges and licence fees in arrears
2.—(1)  Subject to paragraph (2), where any conservancy and service charge or licence fee payable in respect of any commercial, communal or residential property by any tenant, owner or licensee to the Town Council of Pasir Ris-Punggol is in arrears, the tenant, owner or licensee, as the case may be, shall be liable to pay to the Town Council for every month in which there is an arrear a penalty calculated at the rate of —
(a)1% on the amount of the conservancy and service charge due and unpaid each month in respect of a residential property; and
(b)5% on the amount of the conservancy and service charge or licence fee due and unpaid each month in respect of a commercial or communal property.
(2)  The minimum penalty payable each month on any outstanding conservancy and service charge or licence fee under paragraph (1) shall be —
(a)$1 for 1-room flats;
(b)$2 for 2-room flats;
(c)$3 for 3-room flats;
(d)$4 for 4-room flats (inclusive of Design and Build 4-room flats);
(e)$5 for 5-room flats (inclusive of Design and Build 5-room flats), executive apartments (inclusive of Design and Build executive apartments), maisonettes and multi-generation properties (Type A/B/C); and
(f)$30 for commercial or communal properties.
(3)  A penalty determined in accordance with paragraphs (1) and (2) shall be payable for every month in which any conservancy and service charge or licence fee is in arrears on the last day of that month and shall be accumulative until payment is made by the tenant, owner or licensee.
(4)  For the purpose of ascertaining the date on which any conservancy and service charge or licence fee is deemed fully paid, all moneys tendered by any tenant, owner or licensee towards payment of the conservancy and service charges or licence fees will first go towards satisfaction of the longest outstanding charge or fee, followed by the next in time and so forth in the order in which the charges or fees were first imposed.
Administrative fee
3.—(1)  Where any conservancy and service charge or licence fee or any part thereof remains unpaid for a period of 6 months or more from the date on which it was due to be paid, the tenant, owner or licensee shall, in addition to any penalty which may be imposed under by-law 2, be liable to pay to the Town Council an administrative fee of $60.
(2)  The tenant, owner or licensee shall not be liable to pay the administrative fee referred to in paragraph (1) more than once in respect of the same period of 6 months or part thereof.
Right of action or other remedy
4.  Nothing in these By-laws shall prejudice any right of action or other remedy of the Town Council for the recovery of any moneys due to the Town Council under any licence agreement entered into between the Town Council and any licensee.
Application of payment
5.  The Town Council may, in its discretion, apply any moneys paid by a tenant, owner or licensee under these By-laws —
(a)firstly towards the payment of the amount of any penalty or administrative fee payable under these By-laws; and
(b)any balance of such moneys thereafter towards payment of any amount of conservancy and service charges or licence fees or part thereof which is in arrears.
Remission
6.  The Town Council may, in its discretion, remit wholly or in part any penalty or administrative fee payable under these By-laws.
Revocation
7.  The Town Council of Pasir Ris (Penalties for Late Payment of Conservancy and Service Charges, Licence Fees and Other Charges) By-Laws 2001 (G.N. No. S12/2001) and the Town Council of Pasir Ris (Administrative Fee for Late Payment of Conservancy and Service Charges) By-Laws (By 50) are revoked.
Transitional
8.  Where any penalty or administrative fee which has been imposed under the revoked Town Council of Pasir Ris (Penalties for Late Payment of Conservancy and Service Charges, Licence fees and Other Charges) By-Laws 2001 (G.N. No. S 12/2001) or the revoked Town Council of Pasir Ris (Administrative Fee for Late Payment of Service Charges) By-laws (By 50) remains unpaid on 1st February 2002, such penalty or administrative fee shall remain payable as if it had been imposed by the Town Council under these By-Laws.
