Town Councils Act
(Chapter 329A)
Town Councils (Use of Common Property) Rules 2005
In exercise of the powers conferred by sections 19 (1) (c) and 57 of the Town Councils Act, the Minister for National Development hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Town Councils (Use of Common Property) Rules 2005 and shall come into operation on 1st March 2005.
Charges
2.—(1)  A Town Council may impose charges only for the following uses of the following parts of common property in its Town:
(a)Commercial Operations
(i)Installation of telecommunications equipment on any common property.
(ii)Setting up temporary site offices and temporary stores in void decks, open spaces and on the common property of markets and food centres.
(iii)Display of advertisements, banners or signs on any common property with or without the erection of any awnings.
(iv)Installation of “mail transit cabinets and post boxes” on any common property.
(v)Installation and operation of machines called “kiddie riders” on any common property other than void decks.
(vi)Installation of weighing machines on any common property other than void decks.
(vii)Placing one or more vending machines on any common property for the use of the public provided the machine or machines are placed in front of a shop (even if located within a void deck) by an owner or a tenant of the Board occupying the shop.

(viia)Placing one or more vending machines for the use of the public anywhere within a void deck of a building, provided that —
(A)the void deck has no shop or other premises for the carrying on of any trade or business consisting primarily of the sale of goods (including food) or the provision of services by retail (such as a stall, shoplet or kiosk); and
(B)the vending machine or machines do not occupy in total more than 3 square metres of the void deck floor, or a larger area as approved by the Minister in any particular case.

(viii)Distribution of telephone directories in void decks and open spaces.
(ix)Use of open spaces as “traffic gardens”.
(x)Installation and operation of bicycle docking stations on such common property as may be approved by the Minister.
(xi)Street hawking of goods and food approved by the Singapore Food Agency.

(b)Social or Communal functions
(i)Holding weddings, funerals, other social functions and sports and recreational activities in void decks, open spaces and precinct pavilions.
(ii)Holding religious functions such as “wayang”, puppetry, nightly “terawih prayers”, hari raya aidil fitri or hari raya aidil adha prayers in void decks, open spaces and precinct pavilions.
(iii)Holding variety shows, mini fairs, carnivals and book fairs in void decks, open spaces and precinct pavilions.
(iv)Conduct of national campaigns or community development activities such as block parties and Community Day activities by grassroots organisations in void decks, open spaces and precinct pavilions.
(v)Busking on any common property or open space.
(c)Incidental Use for Business
(i)Placing refrigerators, grinding machines and bottled drinks in common areas in the markets and food centres.
(ii)Use of common areas in the markets and food centres for storage purposes.
(iii)Installation of air-condition condensing units and cooling towers in the common areas.
(iv)Placing generators in the common areas.
(v)Installation of awnings outside shops or eating houses.
(vi)Installation of close circuit television cameras on any common property.
(vii)Display of goods in front of a shop by the owner or tenant of the Board occupying that shop.

(viii)Installation of exhaust flues on any common property outside eating houses.
(ix)Installation of monitoring devices and other similar devices as may be required by the relevant authorities.
(x)Placing cylinders containing liquefied petroleum gas (or LPG) on common property outside any retail food establishment, laundromat or any other retail shop not supplying LPG, in order to use the LPG to provide goods or services in the course of its business.

(d)Miscellaneous purposes
(i)Installation and operation of public toilets on the common property of markets, food centres, commercial buildings and shopping centres.
(ii)Use of utility rooms at void decks for the operation of essential maintenance and lift rescue services.
(iii)Setting up of marked pitches on any common property for service vendors such as cobblers, locksmiths and newspaper vendors.
(iv)Setting up of temporary post offices in the common areas.
(v)Use of common property or open space for filming by any broadcasting licensee under the Broadcasting Act 1994.

(vi)Setting up of time-keeper kiosks in the common areas by bus companies.
(vii)Installation of public warning system on roof tops by the Singapore Civil Defence Force.
(viii)Installation of other radio communication equipment on roof tops by Government departments or statutory bodies.
(ix)Installation of amateur radio antennae on roof tops by the Singapore Amateur Radio Transmitting Society.
(x)Setting up of temporary offices on any common property by banks and other service providers.

Revocation
3.  The Town Councils (Use of Common Property) Rules (R 6) are revoked.
